PRESIDENTIAL DECREE No. 152 March 13, 1973

PROHIBITING THE EMPLOYMENT OR USE OF SHARE TENANTS IN COMPLYING WITH REQUIREMENTS OF LAW REGARDING ENTRY, OCCUPATION, IMPROVEMENT AND CULTIVATION OF PUBLIC LANDS, AMENDING FOR THE PURPOSE CERTAIN PROVISIONS OF COMMONWEALTH ACT NO. 141, AS AMENDED, OTHERWISE KNOWN AS THE PUBLIC LAND ACT

WHEREAS, one of the objectives of the State is to abolish tenancy and all its attendant evils, and to emancipate the tenant from the bondage of the soil so as to secure for him a dignified existence consistent with his role as the basic foundation of our society;

WHEREAS, several applicants for, or holders of, lands of the public domain do not occupy and cultivate the lands themselves but have resorted to the pernicious practice of employing or using tenants for the purpose of complying with the entry, occupation and cultivation requirements of the Public Land Act;

Summary of Presidential Decree No. 152

Objectives:
- Abolish tenancy and emancipate tenants from bondage of the soil (Preamble)
- Prohibit the use of share tenants to comply with requirements for entry, occupation, improvement, and cultivation of public lands (Preamble)

Provisions:
• Applicants or grantees of agricultural public lands must enter, work, improve, and cultivate the land themselves within prescribed periods (Section 1)
• Employment or use of share tenants for complying with Public Land Act requirements is prohibited (Section 2)
- Violation is a ground for denial of application, cancellation of grant, and forfeiture of improvements (Section 2)
• Lands rejected, cancelled, or revoked due to violation shall be disposed to qualified persons who will till the land themselves (Section 3)
- Share tenant actually tilling the land has preferential right to acquire the portion tilled, if qualified (Section 3)
• Agricultural lands originally tilled under Public Land Act may be sold to individuals not disqualified (Section 4)
- Essential condition: Vendee shall cultivate the land themselves and not employ or use share tenants (Section 4)
• Provisions of Public Land Act (Commonwealth Act No. 141) contrary to this Decree are amended or repealed (Section 5)
• Decree takes effect immediately (Section 6)
