Providing For Absentee Voting By Officers and Employees of Government Who Are Away From the Place of Their Registration By Reason of Official Functions on Election Day

Executive Order No. 157

EXECUTIVE ORDER NO. 157 March 30, 1987

PROVIDING FOR ABSENTEE VOTING BY OFFICERS AND EMPLOYEES OF GOVERNMENT WHO ARE AWAY FROM THE PLACE OF THEIR REGISTRATION BY REASON OF OFFICIAL FUNCTIONS ON ELECTION DAY

WHEREAS, under the electoral law now in force the rule is that a person has to be physically present in the polling place whereof he is a registered voter in order to be able to vote;

WHEREAS, the only exception is that established by Section 169 of Batas Pambansa Blg. 881, which allows members of the board of election inspectors to vote in the polling place where they are assigned on election day, under certain conditions;

WHEREAS, there are other persons who, by reason of public functions and duties, are assigned on election day in places other than their place of registration, and under existing rules, are thus unable to vote;

WHEREAS, the democratic principle requires the broadest participation in electoral and similar exercises by persons who have all the qualifications and none of the disqualifications to vote;

Absentee Voting for Government Employees on Election Day

- Allows government officials and employees who are away from their place of voter registration due to official duties on election day to vote absentee. (Sec. 1)
- 30 days before the election, the head of office must submit a list of eligible officers and employees to the Commission on Elections (COMELEC), along with a request for absentee ballot application forms. (Sec. 2)
- COMELEC will verify the list and provide the appropriate number of application forms to the head of office. (Sec. 3)
- Accomplished application forms must be returned to COMELEC by April 25, 1987. (Sec. 4)
- COMELEC will verify the applications and transmit the appropriate number of absentee ballots to the head of office for distribution. (Sec. 5)
- The head of office must prepare a sworn report on the distribution of absentee ballots, including the names of recipients and ballot serial numbers. (Sec. 6)
- For the 1987 congressional election, absentee voters can only vote for candidates for senator. (Sec. 7)
- Absentee voters must cast their votes one week before election day by delivering their ballots in two security envelopes to the COMELEC Regional Director, Provincial Election Supervisor, or City/Municipal Election Registrar at their place of assignment. (Sec. 8)
- The COMELEC official receiving the absentee votes must transmit them to the COMELEC central office one day before the elections. (Sec. 9)
- COMELEC will canvass the absentee votes and add the results to the overall vote count. (Sec. 10)
- COMELEC will promulgate necessary rules and regulations to implement this Executive Order. (Sec. 11)
- Section 169 of Batas Pambansa Blg. 881, governing the voting privilege of members of the Board of Election Inspectors, remains in force. (Sec. 12)
- This Executive Order takes effect immediately and repeals or modifies inconsistent laws, orders, issuances, rules, and regulations. (Sec. 13)
