EXECUTIVE ORDER No. 67

PROVIDING FOR THE ESTABLISHMENT OF THE INTEGRATED TRANSPORT SYSTEM

WHEREAS, the 2011-2016 Philippine Development Plan (PDP) of the Aquino Administration prioritizes the creation of an integrated and multimodal transport and logistics system under the Public-Private Partnership (PPP) framework as the Administration’s centerpiece strategy for infrastructure development;

WHEREAS, there is a need to fast-track the establishment of an efficient, reliable, seamless and integrated mass transportation network/system to spur economic growth;

WHEREAS, in pursuance of the policy of prioritizing the creation of an integrated and multimodal transport and logistics system, there is a pressing need to interconnect mass transportation systems, such as buses and railways, to feed into each other and afford an efficient, reliable, seamless and integrated network/system;

WHEREAS, the Department of Transportation and Communications (DOTC) is mandated to be the primary policy, planning, programming, coordinating, implementing, regulating and administrative entity of the Executive Branch of the government in the promotion, development and regulation of dependable and coordinated networks of transportation system,...

Summary of Executive Order No. 67

Establishment of the Integrated Transport System
- The Project aims to establish two integrated transport terminals in the North and South of Metro Manila, with international standards, to provide effective interconnections between different transport modes and services for efficient and seamless travel. (Section 2)
- Other integrated transport terminals may be established for the same purpose. (Section 2)

Fast-Track Implementation
- The Project shall be included in the Public Investment Program (PIP) 2011-2016 by the National Economic and Development Authority (NEDA). (Section 3)
- The Department of Transportation and Communications (DOTC) is directed to fast-track the implementation of the Project with the cooperation of all concerned agencies. (Section 3)

Legal Framework
- The Project shall be structured under any of the schemes allowed under Republic Act No. 6957, as amended, otherwise known as the Build-Operate-and-Transfer (BOT) Law. (Section 4)

Implementing Agency
- The DOTC is designated as the lead agency in the planning, implementation, and monitoring of the Project. (Section 5)

Inter-Agency Committee
- An Inter-Agency Committee is created as an advisory body and consultative forum for the planning, implementation, and monitoring of the Project. (Section 6)
- The Committee is composed of representatives from various agencies, including the DOTC (Chairperson), Metropolitan Manila Development Authority (MMDA) (Vice Chairperson), Department of Public Works and Highways (DPWH), Department of the Interior and Local Government (DILG), NEDA, Land Transportation Franchising and Regulatory Board (LTFRB), and Land Transportation Office (LTO). (Section 6)
- The Chairperson may recommend to the President the inclusion of other members to the Inter-Agency Committee as the circumstances may require. (Section 6)

Functions of the Inter-Agency Committee
- Provide technical advice and recommendations to the DOTC in: (Section 7)
- Overseeing the implementation of the Project. (Section 7a)
- Regulating the terminal fees that may be charged for the use of the transport terminals and other facilities established under the Project. (Section 7b)
- Issuing the implementing rules and regulations, procedures, guidelines, and priority actions necessary to carry out the provisions of this Executive Order. (Section 7c)
- Performing other functions as may be necessary to implement the Executive Order and as may be directed by the President. (Section 7d)

Funding of the Inter-Agency Committee
- The individual agencies shall program the expenses necessary for the operations of the Inter-Agency Committee in their regular budgets. (Section 8)

Role of Other Government Agencies
- The Inter-Agency Committee may call upon any other agency of the Government for assistance as necessary or appropriate in the performance of its functions. (Section 9)
- All heads of departments, agencies, bureaus, offices, including Government-Owned or -Controlled Corporations (GOCCs) are enjoined to render full assistance and cooperation to the DOTC and the Inter-Agency Committee and provide such information and data as may be required to carry out its functions pursuant to this Executive Order. (Section 9)

Repealing Clause
- All executive orders, issuances, rules and regulations or parts thereof which are inconsistent with this Executive Order are hereby repealed or modified accordingly. (Section 10)

Separability Clause
- If any provision of this Executive Order is declared invalid or unconstitutional, the other provisions not affected thereby shall remain valid and subsisting. (Section 11)

Effectivity
- This Executive Order shall take effect immediately upon publication in a newspaper of general publication. (Section 12)
