EXECUTIVE ORDER NO. 193 June 10, 1987
PROVIDING FOR THE REORGANIZATION OF THE OFFICE OF ENERGY AFFAIRS AND FOR OTHER PURPOSES
WHEREAS, under Article II, Section 1, of the Provisional Constitution, as adopted in Proclamation No. 3 dated March 25, 1986, the President shall give priority to measures to achieve the mandate of the people to completely reorganize the government;
WHEREAS, Article XVIII, Section 16, of the 1987 Constitution recognizes that the reorganization of the government shall be continued even after the ratification of the Constitution;
WHEREAS, under Article XVIII, 6, of the 1987 Constitution, the President shall continue to exercise legislative powers until the First Congress is convened;
WHEREAS, pursuant to Executive Order No. 20, dated June 19, 1986 for the administrative supervision of all of the offices, agencies and corporations attached to the Ministry of Energy, the Office of Energy Affairs in the Office of the President was created;

EXECUTIVE ORDER NO. 193
Reorganization of the Office of Energy Affairs
- Background and Rationale (Sections 1-5):
• Pursuant to the 1987 Constitution, the President shall continue the reorganization of the government.
• The Office of Energy Affairs was created under Executive Order No. 20 for the administrative supervision of energy-related offices, agencies, and corporations.
• There is a need to reorganize the Office of Energy Affairs for better administration and formulation of energy plans and policies.
- Reorganization of the Office of Energy Affairs (Sections 6-12):
• The Office of Energy Affairs shall be reorganized and renamed as the Department of Energy. (Section 6)
• The Department of Energy shall be the primary government agency responsible for the preparation, integration, coordination, supervision, and control of plans, programs, and strategies for the exploration, development, utilization, conservation, and distribution of energy resources. (Section 7)
• The Department of Energy shall have the following powers and functions: (Section 8)
• Formulate policies, plans, and programs for the energy sector.
• Recommend legislation and promulgate rules and regulations.
• Supervise and control the operations of attached agencies and corporations.
• Undertake information campaigns and promote the development of energy resources.
• Establish and administer energy programs.
• Promote the utilization of new and renewable energy resources.
• Provide technical and financial assistance to the private sector.
• Undertake research and development in the energy field.
• Collect and maintain data on energy resources.
• Enforce rules and regulations governing the energy sector.
• The Department of Energy shall be headed by a Secretary, who shall be assisted by four Undersecretaries and four Assistant Secretaries. (Section 9)
• The Department of Energy shall have the following services: (Section 10)
• Energy Resource Development Service
• Energy Utilization Management Service
• Energy Research and Testing Service
• Energy Industry Administration Service
• The Department of Energy shall have the following staff offices: (Section 11)
• Financial and Management Service
• Legal Service
• Planning Service
• International Affairs Service
• Public Affairs Service
• The Department of Energy shall have the following attached agencies and corporations: (Section 12)
• Philippine National Oil Company
• National Power Corporation
• National Electrification Administration
• Philippine Nuclear Research Institute
• Bataan Nuclear Power Plant
- Transition and Implementation (Sections 13-25):
• Provisions for the transfer of functions, records, equipment, funds, and personnel from the Office of Energy Affairs to the Department of Energy. (Sections 13-18)
• Provisions for the appointment of officials and employees of the Department of Energy. (Sections 19-22)
• Provisions for the abolition of the Office of Energy Affairs and the transfer of its appropriations, funds, records, equipment, and personnel to the Department of Energy. (Sections 23-24)
• Provisions for the implementation of the reorganization and the issuance of rules and regulations. (Section 25)
- Effectivity (Section 26):
• This Executive Order shall take effect immediately upon its approval.
