Providing For the Reorganization of the Regional Development Councils

Executive Order No. 308

EXECUTIVE ORDER NO. 308 November 5, 1987

PROVIDING FOR THE REORGANIZATION OF THE REGIONAL DEVELOPMENT COUNCILS

WHEREAS, Article X Section 14, of the 1987 Constitution states that: "The President shall provide for Regional Development Councils or other similar bodies composed of local government officials, regional heads of departments and other government offices, and representatives from non-governmental organizations within the regions for purposes of administrative decentralization to strengthen the autonomy of the units therein and to accelerate the economic and social growth and development of the units in the region";

WHEREAS, there is a need to recognize and strengthen further the Regional Development Councils now existing in all the administrative regions of the country in order to make them more effective instruments for regional development, consistent with the aforesaid constitutional mandate.

NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order:

Summary of Executive Order No. 308

Declaration of Policy (Sec. 1):
- The State shall undertake socio-economic development programs and activities with extensive participation, support, and coordination from various government agencies, private sector institutions, at national, regional, and local levels.

Reorganization of the Regional Development Council (Sec. 2):
- The Regional Development Council (RDC) is reorganized and strengthened as the primary institution in the region for setting the direction of economic and social development and coordinating regional development efforts.
- Composition of the RDC (Sec. 2a):
    - All provincial Governors, Mayors of chartered cities and regional center (Sec. 2a(i))
    - Regional Directors of agencies represented in the NEDA Board, with one representative per Department/Agency (Sec. 2a(ii))
    - Representatives of the private sector and non-governmental organizations, not more than one-fourth of the Council members (Sec. 2a(iii))
- Functions of the RDC (Sec. 2b):
    - Coordinate formulation of long-term, medium-term, and annual socio-economic development plans and policies at regional and sub-regional levels (Sec. 2b(i))
    - Coordinate formulation of medium-term and annual public investment programs at regional and sub-regional levels (Sec. 2b(ii))
    - Appraise and prioritize the region's socio-economic development programs and projects (Sec. 2b(iii))
    - Promote and monitor inflow and allocation of private investment capital in the regions (Sec. 2b(iv))
    - Coordinate implementation of programs and projects involving several agencies (Sec. 2b(v))
    - Monitor, evaluate, and formulate recommendations on implementation of development plans and programs in the region (Sec. 2b(vi))
    - Approve Regional Development Plan, Multi-year Regional Development Investment Program, and Regional Annual Investment Program
    - Review and endorse regional budget proposals of government agencies
    - Ensure consistency of local development plans with regional plan priorities
    - Meet at least once every quarter and may create an Executive Committee (Sec. 2b)
    - Report to the President through the NEDA Board (Sec. 2b)
    - Create various Sectoral Committees with private sector and government membership (Sec. 2c)

Regional Consultative Assembly (Sec. 3):
- A Regional Consultative Assembly is created in every region to serve as a deliberative and consultative body to advise, assist, support, and cooperate with the RDC.
- Membership includes members of the RDC and its sectoral committees, heads of other national government agencies in the region, and representatives of non-government organizations, sectarian organizations, and the academe (Sec. 3a)
- Functions include serving as a forum for ideas and recommendations, providing sectoral requirements for development, advising on proposed plans and programs, and providing assistance and support for approved plans and programs (Sec. 3b)

Chairmanship of the Council (Sec. 4):
- The Council shall nominate three members, at least one each from the government and the private sector, for the Chairmanship to the President, who shall appoint the Chairman.
- The Regional Director of the NEDA Secretariat shall be the Vice-Chairman.
- The Chairman and Vice-Chairman shall be the ex-officio Chairman and Vice-Chairman of the Assembly, respectively.

Non-applicability to Autonomous Regions (Sec. 5):
- This Executive Order shall not apply to the autonomous regions in Muslim Mindanao and in the Cordilleras.

Responsibilities of the Council Chairman (Sec. 6):
- Preside over meetings of the Council and Assembly (Sec. 6a)
- Accept donations, contributions, grants, bequests, or gifts in cash or in kind from foreign governments, international offices, private entities, or individuals for purposes relevant to regional development (Sec. 6b)
- Call attention of implementing agencies to implementation problems and institute corrective measures (Sec. 6c)
- Supervise monitoring of implementation of major development programs, projects, and activities (Sec. 6d)
- Represent the region in Cabinet meetings and budget review activities at the national level (Sec. 6e)
- Direct formulation of a comprehensive regional development plan and preparation of a system of investment programming priorities for the region (Sec. 6f)
- Submit to the President through the NEDA Board regional plans, regional investment programs, annual development reports, and other documents on the region as approved by the Council (Sec. 6g)
- Create ad hoc committees as required (Sec. 6h)
- Direct and supervise all activities of the Council (Sec. 6i)
- Perform other functions and duties as directed by the President (Sec. 6j)

Planning and Budgeting Measures (Sec. 7):
- The Development Budget Coordination Committee of the NEDA Board shall modify the process of budget preparation and issue guidelines to provide greater autonomy to the Council in its programs and projects, consistent with regional, provincial, and municipal development plans and national priorities.

Technical Staff of the Council (Sec. 8):
- The Regional Office of the NEDA Secretariat shall serve as the principal technical staff of the Council and the Assembly in the respective regions.
- The Council and the Assembly may request technical support from regional offices of various national government agencies as required.

Implementing Authority (Sec. 9):
- The NEDA Board is authorized to promulgate the necessary rules and regulations to implement this Executive Order.

Effectivity (Sec. 10):
- This Executive Order shall take effect immediately.
