EXECUTIVE ORDER NO. 289 December 13, 1995
PROVIDING LAND FOR THE PHILIPPINE TRADE CENTER IN ACCORDANCE WITH REPUBLIC ACT NO. 7844
WHEREAS, Section 15 of Republic Act No. 7844, otherwise, known as the "Export Development Act of 1994" (The "EDA LAW"), mandates that the Government, in order to assist the private sector in the establishment of Philippine of Philippine Trade Centers, "shall provide the land for the center, through a land grant or a long-term lease to the accredited organization";
WHEREAS, pursuant to the above mandate, the National Government has opted to provide land for the center through a long-term lease to the accredited organization;
WHEREAS, the Philippine Exporters Confederation Inc. (PHILEXPORT), a non-profit, non-stock corporation, is the single umbrella organization of exporters currently accredited by the Export Development Council (EDC) pursuant to R.A. No. 7844 to represent the export sector's concerns and interest;
WHEREAS, the Department of Trade and Industry (DTI), in its capacity as the lead government agency in the Export Development Council and as the government agency tasked under R.A....

Summary of Executive Order No. 289
Providing Land for the Philippine Trade Center
- Pursuant to Section 15 of Republic Act No. 7844 (Export Development Act), the government shall provide land for the Philippine Trade Center through a long-term lease to the accredited export organization. (Section 1)
- The Philippine Exporters Confederation Inc. (PhilExport) is the accredited organization to represent the export sector's concerns and interests. (Section 1)
- The land identified for the Philippine Trade Center is a 50,642 square meter parcel previously owned by the Philippine National Construction Corporation (PNCC) and now owned by the National Government. (Section 1)
- The Secretary of Trade and Industry is authorized to negotiate and execute a long-term lease contract over the land with PhilExport for a term of 3 years. (Section 2)
- The lease rate for the land is fixed at One Thousand Pesos (P1,000.00) per year. (Section 3)
- The leased land shall house the Philippine Trade Center and other complexes like the World Trade Center for international exhibitions and export promotion. (Section 3)
- PhilExport may sublease the land to organizations or firms for setting up the Philippine Trade Center and World Trade Center. (Section 4)
- Revenue earned by PhilExport from the lease rental and operations shall be used solely for export development and promotion as per R.A. No. 7844. (Section 4)
- PhilExport shall regularly report to the Export Development Council (EDC) on the use of funds, and the EDC shall oversee and formulate guidelines within 90 days. (Section 5)
- The capital structure of CITEM under E.O. 989 is modified to comply with this Order regarding the land parcels. (Section 6)
- Provisions inconsistent with this Order, particularly in E.O. 989 regarding the land parcels, are amended or repealed accordingly. (Section 7)
- The provisions of this Order are separable, and if any provision is held unconstitutional, the validity of other provisions shall not be affected. (Section 8)
- This Executive Order is effective immediately. (Section 9)
