Executive Order No. 233

EXECUTIVE ORDER NO. 233 July 22, 1987

REDEFINING THE ROLE AND ORGANIZATIONAL STRUCTURE AND ENLARGING THE MEMBERSHIP OF THE COUNCIL FOR THE WELFARE OF CHILDREN

WHEREAS, it is the policy of the State to promote the well-being and total development of children and youth, and to protect them from exploitation, abuse, improper influence, hazards and other circumstances prejudicial to their physical, mental, emotional, social and moral development;

WHEREAS, the Council for the Welfare of Children has been created under the Office of the President by virtue of Presidential Decree No. 603 otherwise known as THE CHILD AND YOUTH WELFARE CODE with primary functions among others, to coordinate the implementation and enforcement of all laws relative to the promotion of child and youth welfare so as to formulate and evaluate policies, programs and services relative to the development of the general welfare and protection of the best interests of children and youth;

Summary of Executive Order No. 233

Redefining the Role and Organizational Structure of the Council for the Welfare of Children

- Promotes the well-being and total development of children and youth, and protects them from exploitation, abuse, and other harmful circumstances. (Preamble)
- Revises the composition, enlarges the membership, and reorganizes the structure of the Council for the Welfare of Children to enable it to carry out its responsibilities more effectively. (Preamble)
- Redefines the roles and functions of the Council. (Preamble)

Attachment to the DSWD

- The Council shall continue to be an attached agency of the Department of Social Welfare and Development (DSWD). (Section 2)

Composition of the Council

- The Council shall be composed of representatives from various government agencies and three private individuals concerned with child and youth welfare, with at least one being an active member of a legitimate youth organization. (Section 3)
- The three private individuals shall be appointed by the President upon the recommendation of the Chairman and shall serve for two years, subject to renewal. (Section 3)

Powers and Responsibilities of the Council

- Coordinate the implementation and enforcement of all laws related to child and youth welfare. (Section 4a)
- Formulate an integrated national policy and long-range programs, monitor and evaluate their implementation, and protect the best interests of children and youth. (Section 4b)
- Advocate and recommend new, innovative, pilot programs and services for the general welfare of children and youth to the President and other appropriate agencies for nationwide implementation. (Section 4c)
- Mobilize resources and call upon any public, private, or voluntary agency for assistance in performing its functions. (Section 4d)
- Submit an annual comprehensive report on its activities and accomplishments to the President through the Secretary of Social Welfare and Development. (Section 4e)
- Perform other functions as provided by law. (Section 4f)

Executive Director

- The Executive Director shall be appointed by the President upon recommendation of the Chairman and shall have the rank, privileges, and emoluments of a Career Executive Service Officer I, and receive other allowances and benefits as provided by law. (Section 5)
- The Executive Director shall be an ex-officio member of the National Nutrition Council. (Section 5)

Divisions of the Council Secretariat

- The Council Secretariat, headed by the Executive Director, shall have the following divisions: (Section 6)
- Office of the Executive Director
- Administration and Finance Division
- Planning and Programming Division
- Legal and Technical Services Division
- Information, Education and Communications Division

Technical Management Committee

- A Technical Management Committee shall be created under the Council, composed of various Bureau and Service Heads of each government Department and Heads of Non-government organizations as appropriate. (Section 7)

Sectoral Panels

- Five (5) Sectoral Panels are created corresponding to the five major concerns of children and youth: (Section 8)
- Health and Nutrition
- Population and Social Welfare
- Education
- Livelihood and Shelter
- Legal Protection and Welfare

Appropriation and Honoraria

- Adequate funds shall be appropriated annually from the National Treasury for the operation and maintenance of the Council. (Section 9)
- The members and the Chairman of the Council, and members of committees, sectoral panels, and task forces created by the Council shall receive honoraria for every meeting attended, the amount of which shall be determined by a Council resolution and authorized by the Department of Budget and Management. (Section 9)

New Structure and Pattern

- Upon approval of this Executive Order, the officers and employees of the Council shall continue to perform their duties and receive corresponding salaries and benefits in a hold-over capacity. (Section 10)
- The new position structure and staffing pattern shall be approved by the Secretary of the Department of Social Welfare and Development within 120 days from the approval of this Executive Order, and authorized positions shall be filled with regular appointments. (Section 10)
- Those incumbents whose positions are not included or who are not reappointed shall be deemed separated from the service and shall receive retirement benefits or the equivalent of one (1) month basic salary for every year of service, but not exceeding the equivalent of 12 months salary. (Section 10)

Separability Clause

- If any provision of this Order is held invalid, the other provisions not affected shall continue in operation. (Section 11)

Effectivity Clause

- This Executive Order shall take effect immediately. (Section 12)

Repealing Clause

- All laws, issuances, orders, rules and regulations or parts thereof which are inconsistent with this Executive Order are hereby repealed or modified accordingly. (Section 13)
