PRESIDENTIAL DECREE No. 577 November 11, 1974

EXEMPTING DEPENDENTS OF MILITARY PERSONNEL WHO DIE OR BECOME INCAPACITATED IN LINE OF DUTY FROM THE PAYMENT OF TUITION AND MATRICULATION FEES IN PUBLIC OR PRIVATE SCHOOLS, UNIVERSITIES, COLLEGES, AND OTHER EDUCATIONAL INSTITUTIONS

WHEREAS, the members of the Armed Forces of the Philippines, more than any other body of government personnel, have been called upon to carry the great share of the grave burden of suppressing the activities of groups of men engaged in criminal conspiracy to seize state power in the Philippines and of people causing widespread lawlessness, disorder and wanton destruction of lives and property, endangering the political and economic stability of the country;

WHEREAS, the members of the Armed Forces of the Philippines are sacrificing at the risk of their lives and that of their families in order to achieve the preservation of peace and order;

Presidential Decree No. 577

Purpose: To enhance and maintain high morale of military personnel by exempting their dependents from tuition and matriculation fees in educational institutions.

Definitions (Section 1):
- Dependents: Spouse, unmarried children (for married personnel), parents or next of kin (for unmarried personnel).
- Military Personnel: Commissioned officers, enlisted personnel, trainees, and draftees in active service of the Armed Forces of the Philippines.
- Grantee: The military dependent receiving the benefit.
- Benefit: Complete exemption from tuition and matriculation fees.
- School Year: Two semesters and one summer.
- School Levels: Elementary, secondary, and collegiate levels (excluding free school and postgraduate courses).
- Tuition Fee: Fee collected for instruction.
- Matriculation Fee: Fee collected for acceptance and registration.

Scope and Limitations (Section 2):
- Applies to dependents of military personnel who died or were incapacitated in line of duty since September 21, 1972, and those who shall die or be incapacitated hereafter.
- Benefit can be enjoyed for a maximum of 10 school years.
- Benefit is transferable among dependents, but cannot exceed 10 school years.
- Benefit is in addition to other educational benefits previously enjoyed.

Prerequisites and Standards (Section 3):
- Admission of grantees shall follow existing laws and school admission policies.
- Grantees cannot transfer to another school, except for graduation or meritorious reasons.
- Benefit continues as long as grantee passes based on school standards.
- Benefit is suspended if grantee fails any subject or school year (can retake at own expense).
- Benefit is terminated if grantee is expelled or convicted of a crime involving moral turpitude.

Implementation (Section 4):
- Secretary of National Defense, in coordination with Secretary of Education and Culture, shall promulgate necessary rules and regulations.

Penal Provisions (Section 5):
- False representations in connection with application or approval of benefit shall be charged before court martial, military tribunal, or civil court, as appropriate.

Effectivity (Section 6):
- This Decree shall take effect upon approval.
