EXECUTIVE ORDER NO. 239 July 24, 1987
REORGANIZING THE DEPARTMENT OF FOREIGN AFFAIRS AND FOR OTHER PURPOSES
WHEREAS, under Article II, Section 1, of the Provisional Constitution, as adopted in Proclamation No. 3 dated March 25, 1986, the President shall give priority to measures to achieve the mandate of the people to completely reorganize the government;
WHEREAS, Article XVIII, Section 16, of the 1987 Constitution recognizes that the reorganization of the government shall be continued even after the ratification of the Constitution;
WHEREAS, under Article XVIII, Section 6, of the 1987 Constitution, the President shall continue to exercise legislative powers until the First Congress is convened;
WHEREAS, Executive Order No. 132 entitled Reorganizing the Department of Foreign Affairs was signed by the President of February 27, 1987;
WHEREAS, the implementation thereof was suspended;
NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order:

Reorganizing the Department of Foreign Affairs and for Other Purposes
I. Mandate and Authority
- Pursuant to the 1987 Constitution, the President shall give priority to measures to reorganize the government. (Preamble)
- The President shall continue to exercise legislative powers until the First Congress is convened. (Preamble)
II. Reorganization of the Department of Foreign Affairs
- The Department of Foreign Affairs is reorganized into the Office of the Secretary and the following Services: (Sec. 1)
- Foreign Service (Sec. 2)
- Composed of the Foreign Service Corps, Foreign Service Staff Corps, and Foreign Service Employees. (Sec. 2)
- Responsible for the implementation of the foreign policies of the Philippines. (Sec. 2)
- Home Service (Sec. 3)
- Composed of the Home Service Corps and Home Service Employees. (Sec. 3)
- Responsible for providing administrative and technical support services. (Sec. 3)
- Administrative Service (Sec. 4)
- Legal Service (Sec. 5)
- Consular Service (Sec. 6)
- Personnel and Technical Cooperation Service (Sec. 7)
- Intelligence and Security Service (Sec. 8)
- Cultural Service (Sec. 9)
- Economic Service (Sec. 10)
- United Nations and International Organizations Service (Sec. 11)
- Regional Coordination Service (Sec. 12)
III. Organizational Structure and Staffing
- The organizational structure and staffing pattern of the Department shall be prescribed by the Secretary, subject to the approval of the President. (Sec. 13)
- The Secretary shall have supervision and control over the Department. (Sec. 14)
- The Undersecretaries shall assist the Secretary in the administration and supervision of the Department. (Sec. 15)
- The Assistant Secretaries shall assist the Secretary and the Undersecretaries in the performance of their duties and responsibilities. (Sec. 16)
IV. Foreign Service Corps
- The Foreign Service Corps shall be composed of Foreign Service Officers and Foreign Service Staff Officers. (Sec. 17)
- Foreign Service Officers shall be appointed by the President upon the recommendation of the Secretary. (Sec. 18)
- Foreign Service Staff Officers shall be appointed by the Secretary. (Sec. 19)
- The qualifications, compensation, and other benefits of Foreign Service Officers and Foreign Service Staff Officers shall be governed by existing laws, rules, and regulations. (Sec. 20)
V. Foreign Service Employees
- Foreign Service Employees shall be appointed by the Secretary in accordance with the Civil Service Law and rules. (Sec. 21)
VI. Home Service Corps and Home Service Employees
- The Home Service Corps and Home Service Employees shall be governed by existing laws, rules, and regulations. (Sec. 22)
VII. Attachés
- The Secretary may designate Attachés from among the personnel of the Department or from other government agencies. (Sec. 23)
VIII. Diplomatic and Consular Missions
- The Secretary shall have supervision and control over the diplomatic and consular missions of the Philippines. (Sec. 24)
- The heads of diplomatic and consular missions shall be appointed by the President upon the recommendation of the Secretary. (Sec. 25)
IX. Diplomatic Titles and Ranks
- The diplomatic titles and ranks of Foreign Service Officers shall be prescribed by the Secretary, subject to the approval of the President. (Sec. 26)
X. Separation and Retirement
- The separation and retirement of Foreign Service Officers and Foreign Service Staff Officers shall be governed by existing laws, rules, and regulations. (Sec. 27)
XI. Disciplinary Jurisdiction
- The Secretary shall have disciplinary jurisdiction over all personnel of the Department. (Sec. 28)
XII. Delegation of Authority
- The Secretary may delegate authority to officers and employees of the Department as may be necessary for effective administration and operation. (Sec. 29)
XIII. Transfer of Functions, Records, Equipment, and Property
- All functions, records, equipment, and property of the Department of Foreign Affairs shall be transferred to the reorganized Department. (Sec. 30)
XIV. Funding
- The funds necessary for the implementation of this Executive Order shall be taken from the current appropriations of the Department of Foreign Affairs. (Sec. 31)
XV. Implementing Rules and Regulations
- The Secretary shall issue such rules and regulations as may be necessary to implement this Executive Order. (Sec. 32)
XVI. Effectivity
- This Executive Order shall take effect immediately upon its approval. (Sec. 33)
