EXECUTIVE ORDER NO. 262 July 25, 1987

REORGANIZING THE DEPARTMENT OF LOCAL GOVERNMENT AND FOR OTHER PURPOSES

WHEREAS, Article II, Section 1, of Proclamation No. 3 dated March 25, 1986, provides that, the President shall give priority to measures as to achieve the mandate of the people to completely reorganize the government;

WHEREAS, Article XVIII, Section 16, of the 1987 Constitution recognizes that the reorganization of the government shall be continued even after its ratification;

WHEREAS, Under Article XVIII, Section 6, of the 1987 Constitution, the President shall continue to exercise legislative powers until the first Congress is convened;

WHEREAS, local governments must be involved actively in national development especially in the acceleration of economic recovery, in the restoration of political stability, and in the promotion of social progress;

WHEREAS, in their critical participation in national development that is consistent with local autonomy, the development of the executive, technical, and financial capabilities of local governments must be pursued with greater vigor;

Reorganizing the Department of Local Government and For Other Purposes

I. Mandate and Policy Considerations
- Recognizes the need to reorganize the government to achieve the mandate of the people (Sec. 1)
- Aims to actively involve local governments in national development, economic recovery, political stability, and social progress (Sec. 1)
- Seeks to pursue the development of executive, technical, and financial capabilities of local governments (Sec. 1)

II. Reorganization of the Department of Local Government
- Renames the Ministry of Local Government to the Department of Local Government (Sec. 2)
- Outlines the mandate and responsibilities of the Department (Sec. 3)
- Establishes the organizational structure and key positions (Sec. 4-6)

III. Powers and Functions of the Department
- Formulates policies, plans, and programs for the effective governance and administration of local government units (Sec. 7)
- Provides technical and administrative assistance to local government units (Sec. 8)
- Exercises supervision over local government units to ensure compliance with laws and policies (Sec. 9)
- Conducts studies and research on local government administration (Sec. 10)
- Coordinates with other government agencies on matters affecting local governments (Sec. 11)

IV. Local Government Personnel Administration
- Establishes a Local Government Personnel Administration Office to handle personnel matters (Sec. 12)

V. Local Government Finance and Fiscal Administration

VI. Local Government Regional Offices

- Provides for the transfer of personnel, records, equipment, and funds from the former Ministry of Local Government (Sec. 20)
- Authorizes the Secretary to issue rules and regulations for the effective implementation of the Executive Order (Sec. 21)
- Repeals or amends existing laws, orders, and regulations inconsistent with the Executive Order (Sec. 22)
- Provides for the funding and appropriations for the reorganization (Sec. 23-28)

IX. Effectivity
- The Executive Order shall take effect immediately (Sec. 29)
