Case Overview and Summary

Reorganizing the Farm Systems Development Corporation (FSDC)

- Transfers the FSDC from the Ministry of Public Works and Highways to the Ministry of Agriculture and Food to act as the implementing corporate arm of the agricultural productivity program. (Section 1)
- Establishes the Board of Administrators composed of the Minister of Agriculture and Food as ex-officio Chairman, and the NIA Administrator, NFA Administrator, NEA Administrator, DAP President, NFAC Executive Director, and the FSDC Administrator as ex-officio members. (Section 2)
- Authorizes the Board of Administrators to redesign the organizational structure of the FSDC to improve efficiency, productivity, and public service based on the following guidelines: (Section 3)
    - Facilitate planning, organization, direction, coordination, and control of the FSDC's policies.
    - Utilize contemporary management concepts and latest technologies.
    - Streamline systems, procedures, and/or decentralize functions to render faster service without surrendering appropriate controls.
- Authorizes the Board of Administrators to create/abolish positions, classify/reclassify positions, determine compensation rates and packages, and promulgate necessary implementing guidelines for the reorganization. (Section 4)
- Provides for the payment of benefits to officers or employees whose positions are abolished, not appointed, or who refuse appointment in the reorganized FSDC, including: (Section 5)
    - Money value of accumulated vacation and sick leaves and retirement benefits for qualified employees.
    - Gratuity of one month's salary for every year of service (fraction of more than six months considered one full year) based on the highest monthly salary received, payable in lump sum from the savings and salary lapses of the FSDC for employees not qualified for retirement benefits.
- Repeals, amends, or modifies any inconsistent provisions of Presidential Decree No. 681, as amended, and any other law, decree, executive or administrative order, rule or regulation. (Section 6)
- Effective immediately upon issuance. (Section 7)

EXECUTIVE ORDER NO. 1066 November 22, 1985 REORGANIZING THE FARM SYSTEMS DEVELOPMENT CORPORATION WHEREAS, the Farm Systems Development Corporation (FSDC), in its ten (10) years of operation, has successfully organized, supported, assisted and federated small farmer associations which have in turn played a vital role in hastening rural development and increasing food production in the country; WHEREAS, there is a need to strengthen the FSDC and to expand its resources to enable it to effectively implement its goals and objectives; WHEREAS, one way of revitalizing the FSDC is to place it under the jurisdiction of the Ministry of Agriculture and Food; NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested upon me by the Constitution and by law, particularly Presidential Decree No. 1416, as amended, do hereby order the reorganization of the Farm Systems Development Corporation as follows: Sec. 1.
