Executive Order No. 120

EXECUTIVE ORDER NO. 120 January 30, 1987

REORGANIZING THE MINISTRY OF TOURISM, DEFINING ITS POWERS AND FUNCTIONS, AND FOR OTHER PURPOSES.

RECALLING that the reorganization of the government is mandated expressly in Article II, Section 1 (a), and Article III of the Freedom Constitution;

HAVING IN MIND that pursuant to Executive Order No. 5 (1986), it is directed that necessary and proper changes in the organization and functional structures of the government, its agencies and instrumentalities, be effected in order to promote efficiency and effectiveness in the delivery of public services;

CONSIDERING that tourism is an international industry that has played a significant role in boosting the economies of many nations and in fostering goodwill between nations and peoples of the world;

TAKING NOTE that, in order to realize its full tourism potential in the magnitude suggested by the achievements of other countries which have been developed by private enterprises as well as by government, the Philippines, needs:

Summary of Executive Order No. 120

Reorganization of the Ministry of Tourism
- Establishes the Ministry of Tourism to promote and develop the tourism industry in the Philippines. (Section 1)
- Defines the powers and functions of the Ministry of Tourism. (Sections 2-3)

Powers and Functions of the Ministry of Tourism
- Formulate an integrated national tourism policy and promulgate rules and regulations for its implementation. (Section 2a)
- Coordinate the tourism operational activities of other government entities. (Section 2b)
- Represent the Philippines in international tourism organizations and meetings. (Section 2c)
- Negotiate tourism agreements with other countries and international bodies. (Section 2d)
- Accredit tourism enterprises and regulate their operations. (Section 2e)
- Supervise and control the development and promotion of tourism projects and activities. (Section 2f)
- Establish and administer tourism standards and collect tourism statistics. (Section 2g)
- Promote and develop domestic and international tourism. (Section 2h)
- Perform other functions necessary for the effective implementation of the tourism program. (Section 2i)

Organizational Structure of the Ministry of Tourism
- The Ministry shall be headed by a Minister of Tourism. (Section 3)
- The Ministry shall have an Undersecretary and Assistant Secretaries. (Section 4)
- The Ministry shall have a Tourism Coordinating Council. (Section 5)
- The Ministry shall have a Regional Tourism Operations Office in each region. (Section 6)
- The Ministry shall have a Tourism Promotions Board. (Section 7)
- The Ministry shall have a Philippine Convention Bureau. (Section 8)
- The Ministry shall have a Philippine Tourism Training Institute. (Section 9)
- The Ministry shall have a Tourism Infrastructure and Enterprise Zone Authority. (Section 10)

Transfer of Agencies and Personnel
- The Philippine Tourism Authority and its assets, funds, and personnel shall be transferred to the Ministry of Tourism. (Section 11)
- The tourism-related functions and personnel of other government agencies shall be transferred to the Ministry of Tourism. (Sections 12-14)

Transitory Provisions
- Existing tourism-related rules, regulations, and issuances shall remain in force until amended or repealed. (Section 15)
- Pending cases and proceedings shall be continued and acted upon by the Ministry of Tourism. (Section 16)
- Funds and appropriations of the transferred agencies shall be transferred to the Ministry of Tourism. (Section 17)

- The Ministry of Tourism shall submit an annual report to the President and Congress. (Section 18)
- The Ministry of Tourism shall have a seal. (Section 19)
- The Ministry of Tourism shall have a legal service. (Section 20)
- The Ministry of Tourism shall have a public affairs office. (Section 21)
- The Ministry of Tourism shall have a management information system. (Section 22)
- The Ministry of Tourism shall have a tourism research and statistics division. (Section 23)
- The Ministry of Tourism shall have a tourism manpower development division. (Section 24)
- The Ministry of Tourism shall have a tourism standards and accreditation division. (Section 25)
- The Ministry of Tourism shall have a tourism promotions and marketing division. (Section 26)
- The Ministry of Tourism shall have a tourism planning and development division. (Section 27)
- The Ministry of Tourism shall have a tourism operations division. (Section 28)
- The Ministry of Tourism shall have a tourism infrastructure and enterprise zone development division. (Section 29)
- The Ministry of Tourism shall have a tourism services division. (Section 30)
- The Ministry of Tourism shall have a tourism regulation and supervision division. (Section 31)
- The Ministry of Tourism shall have a tourism international relations division. (Section 32)
- The Ministry of Tourism shall have an administrative service. (Section 33)
- The Ministry of Tourism shall have a financial and management service. (Section 34)
- The Ministry of Tourism shall have a regional operations service. (Section 35)
- The Ministry of Tourism shall have a legal affairs service. (Section 36)

Effectivity
- This Executive Order shall take effect immediately upon its approval. (Section 37)
