EXECUTIVE ORDER NO. 309 November 11, 1987
REORGANIZING THE PEACE AND ORDER COUNCIL
WHEREAS, the threat to peace and order posed by criminality, insurgency and subversion requires the dedicated efforts of all government official and citizens;
WHEREAS, it is the duty of local governments, the law enforcement agencies, the prosecution services, and similar institutions of Government to assist the Chief Executive in the proper enforcement of the laws and the administration of justice;
WHEREAS, Government efforts at peace and order need to be fully coordinated to effectively prevent and suppress criminality and to maintain public order and safety in the land;
WHEREAS, the participation of the citizenry in peace and order is of critical importance;
NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Republic of the Philippines, by virtue of the powers vested in me by the Constitution and the laws, do order and direct the following:

Reorganizing the Peace and Order Council
- Reorganizes the Peace and Order Council at the national, regional, provincial, city, and municipal levels of government. (Sec. 1)
National Peace and Order Council Composition: (Sec. 1a)
- Secretary of Local Government as Chairman
- Secretary of Justice
- Secretary of Social Welfare and Development
- Press Secretary
- Director of the National Security Council
- Chairman of the Commission on Human Rights
- Chairman of the National Peace Commission
- Director of the National Bureau of Investigation
- Executive Director of the Dangerous Drugs Board
- AFP Chief of Staff
- Chief of the Philippine Constabulary
- Three representatives from the private sector (academic, civic, and religious organizations)
Regional Peace and Order Council Composition: (Sec. 1b)
- Regional counterparts of the departments, offices, and agencies in the National Council
- Regional Director of the Department of Local Government as Chairman
- Three representatives from the private sector
Provincial Peace and Order Council Composition: (Sec. 1c)
- Provincial counterparts of the departments, offices, and agencies in the National Council
- Provincial Governor as Chairman
- One representative from the Sangguniang Panlalawigan
- Three representatives from the private sector
City/Municipal Peace and Order Council Composition: (Sec. 1d)
- City/Municipal counterparts of the departments, offices, and agencies in the National Council
- City/Municipal Mayor as Chairman
- One representative from the Sangguniang Panlungsod or Sangguniang Bayan
- Three representatives from the private sector
Responsibilities of the National Peace and Order Council: (Sec. 2)
- Prepare and recommend proposals, measures, thrusts, and strategies to respond to peace and order problems. (Sec. 2a)
- Coordinate and monitor peace and order plans, projects, operations of Civilian Volunteer Self-Defense Organizations, and other counter-insurgency programs and activities. (Sec. 2b)
- Perform other duties and functions as directed by the President. (Sec. 2c)
Duties and Functions of Sub-National Councils: (Sec. 3)
- Formulate plans and recommend measures to improve peace and order and public safety in their respective areas. (Sec. 3a)
- Monitor the implementation of peace and order programs, projects, operations of Civilian Volunteer Self-Defense Organizations, and other counter-insurgency programs and activities at their respective levels. (Sec. 3b)
- Make periodic assessments of the prevailing peace and order situation in their respective areas and submit reports with recommendations to the National Council. (Sec. 3c)
- Perform other functions assigned by law, the President, or the National Peace and Order Council. (Sec. 3d)
Peace and Order Council Secretariat: (Sec. 4)
- Handles administrative and technical activities of the Peace and Order Council
- Prepares plans and programs for the Councils
- Supervises, directs, and monitors implementation of approved policies, plans, and programs
- Undertakes liaisoning and coordination with appropriate government agencies
- Provides a forum for interdisciplinary dialogue and deliberation of major issues and problems affecting peace and order
- Chairman of the National Police Commission acts as the Secretary General
Implementing Rules and Regulations: (Sec. 5)
- The National Peace and Order Council shall issue appropriate implementing rules and regulations to carry out this Order.
Repealing Clause: (Sec. 6)
- All prior issuances on the organization and functions of the Peace and Order Council inconsistent with this Order shall be deemed superseded.
Effectivity: (Sec. 7)
- The reorganization of the Peace and Order Council shall take effect immediately and be completed within thirty (30) days thereafter.
