Summary of Executive Order No. 133

Repeal of Executive Order No. 686 (S. 2007)
- Executive Order No. 686 (S. 2007) is expressly repealed.
- This Executive Order transferred the Toll Regulatory Board (TRB) from the Department of Public Works and Highways (DPWH) to the Department of Transportation and Communications (DOTC), but removed certain powers of the TRB and transferred them to the DPWH.

Return of Powers to the Toll Regulatory Board (TRB)
- Any and all powers of the TRB that were transferred by Executive Order No. 686 to the DPWH are hereby returned to the TRB.
- The specific power returned to the TRB is "the power to enter into contracts on behalf of the Republic of the Philippines for the construction, operation and maintenance of toll facilities for highways, roads, bridges and public thoroughfares." (Section 1, Executive Order No. 686)

Mandate and Attachment of the Toll Regulatory Board
- The TRB shall remain an attached agency of the DOTC.
- The TRB's mandate is in accordance with Presidential Decree No. 1112, as amended.

Toll Road Contractual Arrangements
- Nothing in this Executive Order shall be construed as to affect toll road contractual arrangements entered into pursuant to Republic Act No. 7718, as amended.
