Executive Order No. 370

EXECUTIVE ORDER NO. 370 September 26, 1996

STRENGTHENING THE PHILIPPINE COUNCIL FOR SUSTAINABLE DEVELOPMENT

WHEREAS, the 1987 Constitution mandates as a policy of the State the protection and advancement of the right of the people to a balanced and healthful ecology in accordance with the rhythm and harmony of nature;

WHEREAS, the Philippines formally adopted sustainable development as a guiding principle in development efforts through the adoption of a national conservation strategy for sustainable development which was presented by the country during the United Nations Conference on Environment and Development (UNCED) held in Rio de Janeiro;

WHEREAS, the UNCED adopted a resolution for the creation of a Sustainable Development Commission that will evaluate and monitor adherence to the agreements and commitments made in Rio and urged governments to form similar bodies that will ensure that activities at the national level are implemented and coordinated with global efforts;

Summary of Executive Order No. 370

Strengthening the Philippine Council for Sustainable Development (PCSD)
- Strengthens the PCSD structurally and functionally to institutionalize support from key sectors and enhance its ability to coordinate planning, policy formulation, monitoring, and evaluation for sustainable development. (Section 1)

Composition of the PCSD
- Chairperson: Secretary of Socio-Economic Planning (NEDA Director-General) (Section 2.1)
- Vice-Chairperson: Secretary of the Department of Environment and Natural Resources (DENR) (Section 2.1)
- Members from government departments with a rank of director or higher, deputized to represent their respective secretaries. (Section 2.2)
- Nine (9) members from civil society, including people's organizations, non-government organizations, and sectoral/major groups. (Section 2.3)
- Two (2) representatives each from labor and business sectors. (Section 2.4)

Composition of PCSD Committees
- Four (4) committees corresponding to the major areas of concern of the global Agenda 21. (Section 3)
- Committee on Social and Economic Dimensions (CSED) (Section 3.1)
- Committee on Conservation and Management of Resources for Development (CCMRD) (Section 3.2)
- Committee on Strengthening the Role of Major Groups (CSRMG) (Section 3.3)
- Committee on Means of Implementation (CMI) (Section 3.4)

Powers and Functions of the PCSD
- Review and ensure implementation of commitments made by the Philippines in the UNCED and Philippine Agenda 21. (Section 4.1)
- Establish guidelines and mechanisms to operationalize sustainable development principles and incorporate them in the medium-term development plan. (Section 4.2)
- Formulate policy reforms, programs, projects, and recommend new legislations related to environment and sustainable development. (Section 4.3)
- Provide policy advice on environment and sustainable development issues of national interest. (Section 4.4)
- Institutionalize a mechanism for linkage with legislative, executive, local government units, NGOs, business, and other concerned entities/sectors. (Section 4.5)
- Act as the coordinating mechanism with the United Nations Commission on Sustainable Development (UNCSD) and solicit assistance and cooperation. (Section 4.6)
- Review and monitor plans, policies, programs, and legislations on sustainable development and recommend strategies for efficient execution. (Section 4.7)
- Establish a networking mechanism with local and international organizations involved in sustainable development. (Section 4.8)
- Call on any government agencies, resource persons, and other groups as necessary. (Section 4.9)
- Catalyze the formation and institutionalization of local councils for sustainable development. (Section 4.10)
- Establish, reorganize, or abolish committees of the Council. (Section 4.11)
- Perform other acts necessary to carry out its mandated functions and responsibilities. (Section 4.12)

Secretariat
- The Council shall be assisted by a Coordinating Secretariat based at NEDA and a Counterpart Secretariat composed of People's/Non-Government Organization members. (Section 5)

Budget
- A regular line item under the NEDA budget shall be provided in the General Appropriations Act to cover the operational requirements of the Council. (Section 6)

Repealing Clause and Effectivity
- All Executive Orders inconsistent with this order are repealed or amended accordingly. (Section 7)
- This Executive Order shall take effect immediately. (Section 8)
