EXECUTIVE ORDER No. 419 April 4, 2005
TEMPORARILY INCREASING THE RATES OF IMPORT DUTY OF HIGH ENGINE DISPLACEMENT COMPLETELY BUILT UP VEHICLE UNDER SECTION 104 OF THE TARIFF AND CUSTOMS CODE OF 1978 (PRESIDENTIAL DECREE NO. 1464), AS AMENDED
WHEREAS, it is a declared policy of the government to promote the judicious conservation and efficient utilization of energy resources thereby adopting the most cost-effective options toward the wiser and efficient use of energy;
WHEREAS, the transport sector is one of the highest energy-consuming sector next to the industrial manufacturing sector;
WHEREAS, Republic Act No. 8749 otherwise known as the Philippine Clean Air Act of 1999 was promulgated to promote and protect the environment including its air sheds against pollution from mobile sources, among others;
WHEREAS, Section 401 of the Tariff and Customs Code of 1978, as amended, empowers the President of the Republic of the Philippines, to increase, reduce or remove existing rates of import duty, as well as, to modify the tariff nomenclature.

Summary of Executive Order No. 419
Purpose and Policy Considerations
- To promote judicious conservation and efficient utilization of energy resources by adopting cost-effective options for wiser and efficient energy use. (Preamble)
- To address the high energy consumption in the transport sector, which is one of the highest energy-consuming sectors next to industrial manufacturing. (Preamble)
- To promote and protect the environment, including air sheds, against pollution from mobile sources, as mandated by the Philippine Clean Air Act of 1999 (Republic Act No. 8749). (Preamble)
Import Duty Rates Increase
- The President is empowered to increase, reduce, or remove existing rates of import duty and modify the tariff nomenclature under Section 401 of the Tariff and Customs Code of 1978, as amended. (Preamble)
- The articles listed in Annex "A" of the Executive Order, classified under Section 104 of the Tariff and Customs Code of 1978, as amended, shall be imposed the Most Favored Nation (MFN) rates of import duty according to the schedule indicated opposite each article. (Section 1)
- Upon the effectivity of this Executive Order, the articles listed in Annex "A" that are entered and withdrawn from warehouses in the Philippines for consumption shall be levied the prescribed MFN rates of duty. (Section 2)
Exemption
- Registered participants under Executive Order No. 244, as amended by Executive Order No. 312, otherwise known as the "Automotive Export Program," are exempted from this Executive Order. (Section 3)
Revocation and Modification
- All Presidential issuances, administrative rules and regulations, or parts thereof, which are inconsistent with this Executive Order are hereby revoked or modified accordingly. (Section 4)
Effectivity and Duration
- This Executive Order shall be effective for a period of one (1) year, subject to review. (Section 5)
- This Executive Order shall take effect thirty (30) days following its complete publication in two (2) newspapers of general circulation in the Philippines. (Section 6)
