Summary of Presidential Decree No. 1744 Amending Article 320 of the Revised Penal Code on ArsonImposition of Death Penalty for Arson
• The penalty of reclusion temporal in its maximum period to death shall be imposed for arson under the following circumstances: (Section 1)
- Burning one or more buildings/edifices in a single act, simultaneous burnings, or on different occasions.
- Burning any public or private building where people gather, such as for official functions, business, commerce, trade, worship, meetings, hotels, motels, public transportation terminals, etc., regardless of knowledge of people inside or whether inhabited. (Section 1.2)
- Burning any train, ship, airship, or airplane used for transportation, public use, entertainment, or leisure. (Section 1.3)
- Burning any building, factory, warehouse, or installation devoted to public utilities. (Section 1.4)
- Burning a building to conceal evidence of another violation, bankruptcy, or insurance fraud. (Section 1.5)
• The death penalty shall be imposed when the arson is committed by two or more persons or a group, regardless of their purpose. (Section 1)
• The penalty of reclusion temporal in its maximum period to death shall also be imposed for burning: (Section 1)
- Any arsenal, shipyard, storehouse, military powder or fireworks factory, ordinance storehouse, archives, or government museum. (Section 1.a)
- In an inhabited place, any storehouse or factory of inflammable or explosive materials. (Section 1.b)
• If death, injury, or destruction of valuable documents, equipment, machineries, apparatus, or other valuable properties results from the arson, the mandatory death penalty shall be imposed. (Section 1)

PRESIDENTIAL DECREE No. 1744
AMENDING ARTICLE THREE HUNDRED AND TWENTY OF THE REVISED PENAL CODE PROVISIONS ON ARSON
WHEREAS, there have been rampant and wanton burnings of residential houses, public buildings, markets, hotels, and other commercial establishments;
WHEREAS, to effectively discourage and deter the commission of arson, and to prevent destruction of properties and protect the lives of innocent people, it is necessary that the capital punishment be imposed upon arsonists;
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order and decree that Article 320, Revised Penal Code be amended:
Section 1. Article 320 of the Revised Penal Code shall read as follows:
"Article 320 Destructive Arson. The penalty of reclusion temporal in its maximum period to death shall be imposed upon any person who shall burn:
