General

1. All forms of use of this website including but not limited to the use of the legal research, lawyer matching, and Artificial Intelligence (AI) shall be hereinto referred to as "Service".

2. Description of Service

  • Digest is a Software-as-a-Service (SaaS) platform that provides users with access to paid content, including Philippine court decisions, laws, and regulatory issuances. Access to this content is available through monthly subscriptions.

3. Subscription and Payment

  • a. Subscription Plans: Users can choose from various monthly subscription plans to access paid content. Details of subscription plans and pricing are available on the website.
  • b. Payment: All payments for subscriptions are processed through secure payment gateways. By subscribing, you authorize Digest to auto charge your chosen payment method for the applicable subscription fees. You may cancel your renewal by going to the user dashboard, clicking subscriptions, and cancelling your plan. Failure to cancel the auto-renew will lead to the renewal of the plan and continued access to the website.
  • c. No Refund Policy: All subscription fees are non-refundable. Once a subscription fee is paid, it cannot be refunded, regardless of the duration of use or circumstances of termination. In meritorious cases to be decided on a case-to-case basis, Digest, may at its sole discretion, grant plans or credits that can be used by the user for further use in the website.

4. User Responsibilities

  • a. Account Security: You are responsible for maintaining the confidentiality of your account information, including your username and password. You agree to notify Digest immediately of any unauthorized use of your account.
  • b. Prohibited Conduct: You agree not to use the Service for any unlawful purpose or in any way that might harm, disrupt, or impair the Service.

5. Disclaimer of Warranties

  • a. Accuracy of Information: While Digest strives to provide accurate and up-to-date information, we do not warrant that any content is 100% accurate, complete, or current. The information provided is for informational purposes only and should not be construed as legal advice.

7. Account deletion

  • You may request to delete your account by informing us through your designated email associated with your account and attaching a signed letter specifically requesting the deletion plus a government Identification Document (ID) of yourself. The purpose is to verify that the user is the one requesting the deletion. Such account deletion is irrevocable and we do not warrant that we may ever be able to restore your account.

8. DIGEST reserve the right to discipline, suspend, ban, block, or otherwise restrict users who do not comply with this Terms of Use or engage in conduct prejudicial to the interest of DIGEST. DIGEST reserves the right to remove any content from the website.

Personal Information collected from each user depends on the usage of the DIGEST Website (“Website”) which includes, but not limited to, visiting the Website, using legal resources in the Website, claiming a lawyer’s profile, using DIGEST’s messaging and video conferencing features, and/or using DIGEST’s mobile app (“DIGEST’s Services”). By using DIGEST’s Services and submitting information, you consent to giving us your personal data. Your personal data will not be sent to third parties for any purpose whatsoever.

    2. Personal Information is defined under the Data Privacy Act of 2012 or Republic Act No. 10173 as any information whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual.

    3. DIGEST may collect the following information:

    • a. From All Users:

        i. Names, online identifiers, Internet Protocol addresses (“IP addresses”), location, email addresses, and identification card details.

        ii. Internet or other electronic network activity information that DIGEST may collect includes browsing history, search history, information about the device the consumer is using to access our website or applications, and information regarding a user’s interaction with Website, DIGEST’s mobile applications, and advertisements. DIGEST may also collect information on browser settings, operating systems, referring/exit pages, and clickstream data.

        iii. When DIGEST sends you an email, DIGEST may collect information, including about how you interact with that email.

        iv. DIGEST may collect data from messages or queries of a user before it is claimed by a lawyer. Once claimed by a lawyer, DIGEST has no access and does not collect any information transmitted through the messaging and/or video conferencing function of the website or mobile app. DIGEST recognizes that all exchanges between the lawyer and another user through DIGEST’s Services are privileged and confidential.

    • b. From Users Who Will Create an Account: Names, online identifiers, Internet Protocol addresses (“IP addresses”), location, email addresses, identification card details and identification photo.

    • c. From Lawyers Who Will Claim Their Profile in DIGEST: Names, Roll of Attorney Numbers, online identifiers, IP addresses, location, email addresses, practice areas, work experience, professional fees, identification card details and identification photo.

    • d. From Users who claim the law student plan: law student data in order to verify the discount.

    4. DIGEST employs cookies and data analytics in order to improve the performance of DIGEST’s Services. DIGEST collects information based on your usage of DIGEST’s Services. DIGEST reserves the right to allow third parties to display ads and other materials in DIGEST’s Services.

    5. Unless otherwise provided in this Privacy Policy or in DIGEST’s website, the information collected from users will not be disclosed in the Digest’s website.

    6. Through your use of this Website and accessing of our Service, you consent to the collection, use, retention, and sharing of your personal information in accordance with the Privacy Policy and within the limits of data privacy laws, including DPA. We use your contact information in providing our services, answering your requests, billing and other management purposes, and marketing and communicating purposes, and in analyzing service trends through the usage of data in aggregated/anonymized form. We note that all marketing newsletters we send contain an option for you to opt-out at any time. Furthermore, Cinnamon does not record or store credit information from Users, and rely on third-party payment processors for credit card processing.

    1. DIGEST implements reasonable and appropriate organizational, physical, and technical measures intended for the protection of personal information against any accidental or unlawful destruction.

    2. DIGEST will implement reasonable and appropriate measures to protect the personal information against natural dangers such as accidental loss or destruction, and human dangers such as unlawful access, fraudulent misuse, unlawful destruction, alteration and contamination.

    3. DIGEST employs safeguards to protect DIGEST’s computer network against accidental, unlawful, or unauthorized usage, or interference with or hindering of their functioning or availability.

    4. DIGEST will notify you within a reasonable time when sensitive personal information or other information that may be used to enable identity fraud are reasonably believed to have been acquired by an unauthorized person, and there is a real risk of serious harm to any affected data subject.
