Summary of Republic Act No. 11239

Disposition of Motor Vehicle User's Charge Collections (Section 1)
- All monies collected from the motor vehicle user's charge shall be remitted to the National Treasury under a special account in the General Fund.
- The funds shall be earmarked solely for the construction, upgrading, repair, and rehabilitation of roads, bridges, and road drainage.
- The funds shall be included in the annual General Appropriations Act.

Repeal of Section 8 of Republic Act No. 8794 (Section 2)

Implementing Rules and Regulations (Section 3)
- The Secretaries of the DBM, DPWH, and DOTr shall jointly promulgate the rules and regulations to implement the Act within 30 days from its effectivity.
- The rules shall ensure the prudent, wise, effective, and efficient utilization of the special funds.

Abolition of the Road Board (Section 5)
- The Road Board created by Republic Act No. 8794 is hereby abolished.

Absorption of Affected Personnel, Separation and Retirement Benefits (Section 6)
- The DPWH shall absorb the employees of the Road Board's secretariat, without diminution of their salaries and other benefits.
- Employees who are separated shall receive separation benefits under Republic Act No. 6656.
- Qualified employees shall be allowed to retire and receive retirement benefits under applicable laws.

Transfer of Rights, Assets, and Liabilities (Section 7)
- The DPWH shall be subrogated to all the rights and assume all the obligations and liabilities of the Road Board.
- All records, property, assets, equipment, and funds of the Road Board, including unexpended appropriations or allocations, shall be transferred to the DPWH.

Congressional Oversight Committee (Section 8)
- A Congressional Oversight Committee is created to monitor the implementation of Republic Act No. 8794, as amended, and the use of the special funds.
- The Committee shall be composed of 5 Members of the House of Representatives and 5 Senators, including 1 Member from the Minority of each House.
- The Committee shall be jointly chaired by a Member of the House of Representatives and a Senator.

Separability Clause (Section 9)
- If any provision or part of this Act is declared unconstitutional or invalid, the remaining parts or provisions not affected shall remain in full force and effect.

Repealing Clause (Section 10)
- All laws, decrees, orders, rules and regulations, and other issuances or parts thereof inconsistent with the provisions of this Act are hereby repealed or modified accordingly.

Effectivity (Section 11)
- This Act shall take effect 15 days after its publication in the Official Gazette or in a newspaper of general circulation.

REPUBLIC ACT NO. 11239 AN ACT ABOLISHING THE ROAD BOARD AND PROVIDING FOR THE DISPOSITION OF THE MOTOR VEHICLE USER'S CHARGE COLLECTIONS, AMENDING FOR THE PURPOSE REPUBLIC ACT NO. 8794, ENTITLED "AN ACT IMPOSING A MOTOR VEHICLE USER'S CHARGE ON OWNERS OF ALL TYPES OF MOTOR VEHICLES AND FOR OTHER PURPOSES" SECTION 1. Section 7 of Republic Act No. 8794 is hereby amended to read as follows: "SEC. 7. Disposition of Monies Collected. — All monies collected under this Act shall be remitted to the National Treasury under a special account in the General Fund to be earmarked solely for the construction, upgrading, repair, and rehabilitation of roads, bridges, and road drainage to be included in the annual General Appropriations Act."
