Summary of Republic Act No. 6645Filling Vacancies in Congress
- If a vacancy arises in the Senate at least 18 months or in the House of Representatives at least 1 year before the next regular election, a special election shall be held to fill the vacancy. (Section 1)
- The Commission on Elections shall hold the special election upon receipt of a resolution from the Senate or House of Representatives certifying the vacancy and calling for a special election. (Section 1)
- If Congress is in recess, an official communication from the Senate President or House Speaker on the vacancy and call for special election is sufficient. (Section 1)
- The elected Senator or Representative shall serve only for the unexpired term. (Section 1)
Scheduling the Special Election
- The Commission on Elections shall fix the date of the special election, which shall be no earlier than 45 days and no later than 90 days from the date of the resolution or communication. (Section 2)
- If a general election is scheduled within the 45-90 day period, the special election shall be held simultaneously with the general election. (Section 2)
Publication of Notice
- The Commission on Elections shall send copies of the resolution to the Provincial or City Treasurer of each concerned province or city for due distribution and publication. (Section 3)
- The Treasurers shall publish the resolution by posting at least three copies in conspicuous places in each election precinct, a copy in each polling place and public market, and a copy in municipal buildings. (Section 3)
Effectivity
- This Act shall take effect upon its publication in the Official Gazette or in at least two newspapers of general circulation. (Section 4)

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled::
Section 1.
