Summary of Republic Act No. 6636Resetting of Local Elections
- The local elections for provincial governors, vice-governors, city and municipal mayors, vice-mayors, and members of local legislative councils are reset to January 18, 1988. (Section 1)
- Certificates of candidacy must be filed not later than 60 days prior to the elections. (Section 1)
Automatic Resignation of Incumbent Officials
- All incumbent local officials are deemed automatically resigned upon filing their certificates of candidacy, which must be done not later than 45 days prior to the elections. (Section 1)
- Acting officers-in-charge are designated in the following order: (1) Chief, Senior and Local Government Officers, (2) Provincial/City/Municipal Administrator, (3) Provincial/City/Municipal Health Officer. (Section 1)
Metro Manila Area
- Manila, Quezon City, and Caloocan City will have 6 councilors for each representative district, elected by qualified voters therein. (Section 2)
- Pasay City, Makati, Parañaque, Pasig, Marikina, and Valenzuela will have 12 councilors each, elected at large. (Section 2)
- Other municipalities in Metro Manila will have 10 councilors each, except Pateros with 8 councilors, elected at large. (Section 2)
Other Cities
- Cebu City, Davao City, and cities with more than one representative district will have 8 councilors for each district, elected by qualified voters therein. (Section 3)
- Cagayan de Oro, Zamboanga, Bacolod, Iloilo, and other cities comprising a representative district will have 12 councilors each, elected at large. (Section 3)
- All other cities will have 10 councilors each, elected at large. (Section 3)
- The present number of councilors according to city charters shall not be reduced. (Section 3)
Provinces and Municipalities
- First and second class provinces will have 10 elective members, elected at large. (Section 4)
- Third and fourth class provinces will have 8 elective members, elected at large. (Section 4)
- Fifth and sixth class provinces will have 6 elective members, elected at large. (Section 4)
- Other municipalities will have the same number of elective members as provided in existing laws. (Section 4)
Term of Office
- Elected local officials will assume office at noon on February 2, 1988 and serve until noon of June 30, 1992. (Section 5)
- If no candidate is elected and qualified, the officer-in-charge shall continue to hold office until the duly elected officer qualifies. (Section 5)
Election and Campaign Periods
- The election period is from November 19, 1987 to February 17, 1988. (Section 6)
- The campaign period is 45 days, commencing on December 1, 1987 and ending on January 17, 1988. (Section 6)
- Campaigning is prohibited on December 25, December 30, 1987, and January 1, 1988. (Section 6)
Voter Registration
- There will be a special voter registration on November 28, 1987 for those who turn 18 on January 18, 1988 or failed to register previously. (Section 7)
- The Commission may order a general re-registration of voters in certain areas to eliminate illegal registration. (Section 7)
Appropriations
- An amount of ₱220,000,000 is set aside from the annual budget and savings of the Commission on Elections for the local elections. (Section 8)
- The funds shall be released automatically by the Department of Budget and Management upon request of the Commission Chairman. (Section 8)
- In case of deficiencies, the funds shall be augmented from the contingent fund or other applicable appropriations. (Section 8)
Separability Clause
- If any part of the Act is held unconstitutional or invalid, the other parts not affected shall remain in full force and effect. (Section 9)
Effectivity Clause
- The Act shall take effect upon its approval. (Section 10)

AN ACT RESETTING THE LOCAL ELECTIONS FROM NOVEMBER 9, 1987 TO JANUARY 18, 1988, AMENDING FOR THIS PURPOSE EXECUTIVE ORDER NUMBERED TWO HUNDRED AND SEVENTY
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled::
Section 1. Section 1 of Executive Order No. 270 is hereby amended to read as follows:
"Sec. 1. Election of local official. - There shall be elections for provincial governors, provincial vice-governor, city and municipal mayors, city and municipal vice-mayors, and members of each Sangguniang Panlalawigan, Sangguniang Panlungsod, and Sangguniang Bayan, including all members of the city or municipal boards or councils in the Metropolitan Manila area to be held on Monday, January 18, 1988. Certificates of candidacy for the aforesaid local elective positions shall be filed not later than sixty (60) days prior to the said elections.
