Case Overview and Summary

Summary of Administrative Order No. 16

Scope and Mandatory Coordination
- Applies to all government entities, including local government units, government-owned and controlled corporations, government corporate entities, government instrumentalities with corporate powers, government financial institutions, and state universities and colleges. (Section 1)
- Government entities must coordinate with the National Mapping and Resource Information Authority (NAMRIA) regarding the acquisition of data from airborne and spaceborne platforms, such as aerial photographs and satellite imageries, for mapping purposes. (Section 2)
- Government entities must submit a complete inventory and index of all their data holdings to NAMRIA within one month from the order's effectivity. (Section 2)
- NAMRIA shall consider the requirements of other agencies in formulating and implementing nationwide programs on data acquisition, aerial photography, topographic base mapping, and other remote sensing mapping activities. (Section 2)

Procurement
- Data from airborne and spaceborne platforms, such as satellite imageries and aerial photographs, and other related products and services for mapping purposes, shall be procured from the Procurement Service of the Department of Budget and Management, except for projects funded by foreign grants or official development assistance. (Section 3)

NAMRIA Clearance
- Government entities intending to procure data from airborne and spaceborne platforms and other related products and services for mapping purposes must secure a clearance certificate from NAMRIA. (Section 4)
- The clearance certificate shall state: (Section 4)
- The technical specifications and standards of the proposed procurement are appropriate, considering the requirements of other user agencies.
- The requirements of the procuring entity could not be fully or economically satisfied by the inventory and ongoing procurement of other government entities.
- NAMRIA shall advise the procuring entity within 15 days on compliance or non-compliance, recommend changes in specifications and scope, resolve overlapping procurements, or issue a conditional clearance certificate. (Section 4)

Maintenance of Database
- All government entities shall, as far as practicable, furnish NAMRIA with metadata and copies of all imageries, aerial photographs, and map outputs for integration into NAMRIA's database. (Section 5)

Repeal and Separability
- All orders or issuances inconsistent with this Administrative Order are repealed or modified accordingly. (Section 6)
- If any provision is declared invalid or unconstitutional, the other provisions shall remain valid and subsisting. (Section 7)

Effectivity
- This Administrative Order shall take effect immediately. (Section 8)
