Case Overview and Summary
REGISTRATION OF OWNERSHIP AND/OR TITLE TO LAND UNDER PRESIDENTIAL DECREE NO. 27- Filing and Recording of Land Transfer Certificates (Section 1):
• Land Transfer Certificates issued under PD 27 shall be filed by the Department of Agrarian Reform with the Land Registration Commission.
• The Commission shall transmit a copy to the Register of Deeds where the land is located.
• For registered lands, the Register of Deeds shall annotate a memorandum in the certificate of title without surrendering the owner's duplicate.
• For unregistered lands, the Register of Deeds shall record the Land Transfer Certificate in the registration book.
- Issuance of Emancipation Patent and/or Grant (Section 2):
• The Department of Agrarian Reform shall issue an Emancipation Patent and/or Grant after the tenant-farmer complies with requirements under PD 27.
• For registered lands, the Register of Deeds shall issue a new transfer certificate of title to the grantee after canceling the original title.
• The owner's duplicate must be surrendered within 30 days, or the Register of Deeds can cancel it.
• For unregistered lands, the filing of the Patent/Grant brings the land under Act 496, and the Register of Deeds shall issue an original certificate of title.
- No Fees or Taxes (Section 3):
• No fees, premiums, taxes, postage dues, or mailing charges shall be imposed for the issuance and registration of documents and titles under this Decree.

PROVIDING FOR THE MECHANICS OF REGISTRATION OF OWNERSHIP AND/OR TITLE TO LAND UNDER PRESIDENTIAL DECREE NO. 27
WHEREAS, the present laws do not adequately provide for a method of registering the ownership of tenant-farmers covered by Presidential Decree No. 27, and
WHEREAS, there is urgent need of registering such rights to prevent confusion in land titles;
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers in me vested by the Constitution as Commander-in-Chief of all the Armed Forces of the Philippines, and pursuant to Proclamation No. 1081, dated September 21, 1972, and General Order No. 1, dated September 22, 1972, as amended, do hereby decree and order the registration of said rights in the following manner;
