- Organized/syndicated crime group means two or more persons collaborating in organized crime.
• Special Committee (Section 2):
- Composed of the Minister of National Defense, Minister of Justice, and Tanodbayan (or representatives).
- Exercises functions related to compelling witness testimony and recommending arrest.
- Unanimous vote required for compelling testimony or recommending arrest.
• Compelling Witness Testimony (Section 3):
- Applies to cases involving national security, public order, organized crime, or crimes punishable by at least prision mayor.
- Prosecutor can apply to the Committee to compel a witness invoking self-incrimination to testify or produce evidence.
- Committee considers necessity, lack of other evidence, corroboration, and relative guilt of the witness.
- Committee can issue an order compelling testimony/evidence, except for privileged matters.
• Immunity from Prosecution (Section 4):
- A witness compelled to testify or produce evidence enjoys immunity from criminal prosecution related to that testimony/evidence, except for perjury or contempt (Section 5).
• Arrest and Confinement (Section 6):
- If a witness refuses to comply with the Committee's order, the President may order their arrest and confinement until compliance, upon the Committee's recommendation.
- The witness can request reconsideration, but execution is not stayed.
- The President may temporarily release the confined witness under certain conditions.
• Implementation (Section 7):
- The Committee shall promulgate rules and regulations for effective implementation.
• Inconsistency and Separability (Sections 8-9):
- Inconsistent laws, decrees, orders, rules, and regulations are repealed or modified.
- The provisions of this Decree are separable, and the validity of other provisions is not affected if one is held unconstitutional.

PRESIDENTIAL DECREE No. 1732
PROVIDING IMMUNITY FROM CRIMINAL PROSECUTION TO GOVERNMENT WITNESSES AND FOR OTHER PURPOSES
WHEREAS, reports of law enforcement agencies reveal that activities of criminal elements in the country have become sophisticated, diversified and widespread;
WHEREAS, these activities have resulted not only in the wanton destruction of lives and property, but have likewise weakened the Nation's economic stability, threatened its security and undermined the general welfare of its citizens;
WHEREAS, crime continues to grow due to, among other reasons, the limited and inadequate system of evidence-gathering and the seeming apathy and reluctance of the citizenry in testifying against criminal elements for fear of reprisal;
WHEREAS, it is imperative to provoke the total involvement of the citizenry in the campaign against these criminal elements by providing immunity from criminal prosecution to any witness who shall give vital information to the government concerning the existence, operation and activity of such criminal elements, and to provide for a compulsory process against uncooperative and recalcitrant witnesses;
