Summary of Executive Order No. 165

Transfer of Agencies to the Office of the President
- The following agencies are transferred from the Department of Agriculture to the Office of the President:
• National Food Authority (NFA) - Created by Presidential Decree No. 4 (s. 1972), as amended, to ensure adequate and continuous supply of food at reasonable prices. (Section 1)
• National Irrigation Administration (NIA) - Created by Republic Act No. 3601 (1963), as amended, to expand irrigated farmlands, increase productivity, and ensure stable supply of farm commodities. (Section 1)
• Philippine Coconut Authority (PCA) - Created by Presidential Decree No. 232 (s. 1973), as amended, to promote the accelerated development of the coconut and other palm oils industry. (Section 1)
• Fertilizer and Pesticide Authority (FPA) - Created by Presidential Decree No. 1144 (s. 1977), to ensure adequate supplies of fertilizer and pesticide at reasonable prices, rationalize their manufacture and marketing, protect the public from risks of pesticide use, and educate the agricultural sector on their use. (Section 1)

Rationale for Transfer
• There is a need to enhance and coordinate the efforts of the NFA, NIA, PCA, and FPA, which are attached agencies to the Department of Agriculture, in fulfilling their respective mandates. (Section 1)
• The President has the continuing authority to reorganize the administrative structure of the Office of the President, including transferring any agency to the Office of the President from other departments and agencies, pursuant to Paragraph 3, Section 31, Chapter 10, Title III, Book III of Executive Order No. 292 (s. 1987) or the Administrative Code of 1987. (Section 1)

Repealing Clause
• All issuances, orders, rules and regulations, or parts thereof, which are inconsistent with this Order are hereby repealed, amended or modified accordingly. (Section 2)

Effectivity
• This Order shall take effect immediately. (Section 3)

MALACAÑAN PALACEMANILA BY THE PRESIDENT OF THE PHILIPPINES EXECUTIVE ORDER No. 165 TRANSFERRING THE NATIONAL FOOD AUTHORITY, NATIONAL IRRIGATION ADMINISTRATION, PHILIPPINE COCONUT AUTHORITY, AND FERTILIZER AND PESTICIDE AUTHORITY TO THE OFFICE OF THE PRESIDENT WHEREAS, the National Food Authority (NFA) was created by virtue of Presidential Decree (PD) No. 4 (s. 1972), as amended, in order to strengthen the national strategy for the integrated growth and development of the food industry to insure adequate and continuous supply at reasonable prices; WHEREAS, the National Irrigation Administration (NIA) was created by virtue of Republic Act No. 3601 (1963), as amended, to expand irrigated farmlands in order to better program the production of agricultural crops, increase the productivity of our farmers and ensure a stable supply of farm commodities; WHEREAS, the Philippine Coconut Authority (PCA) was created by virtue of PD No. 232 (s. 1973), as amended, in order to promote the accelerated development of the coconut and other palm oils industry; WHEREAS, the Fertilizer and Pesticide Authority (FPA) was created by virtue of PD No. 1144 (s....
