[SEC CASE NO. 3222. November 17, 1987.]ARTEMIO VALDEZ, ET AL., petitioners, vs. MANUEL L. GONZALES, respondent.O R D E RWhen this case was called for hearing only the petitioners and their counsel appeared despite due notice sent to all the parties. Counsel for the petitioners manifested and moved that, in view of the urgency of the incidents involved in this case and considering that the respondent was duly notified of the hearing, they be allowed to present evidence ex-parte in support of the injunctive relief prayed for, and which motion was granted subject to the condition that the witness is to be presented by the petitioners shall be cross-examined by the respondent. TcIHDaWHEREFORE, the hearing for the cross-examination of witness Alejandro Gavino by the respondent is hereby set on December 15, 1987 at 10:00 o'clock in the morning. Failure on the part of the respondent to appear and cross-examine the witness on the aforesaid scheduled date of hearing shall be considered as a waiver on his part to cross-examine the witness.
