MAGDALENA D. SUNGA, ET AL., petitioners, vs. ROSE MARIE A. LUTZ , ET AL.,first-set-respondents and JOSIAS V. CHAVEZ, ET AL., second-set-respondents.

O R D E R

When this case was called for hearing, only petitioner Magdalena D. Sunga and respondent Josias V. Chavez appeared without the assistance of their respective counsel.

The Commission, upon oral manifestation of the petitioner that her lawyer is on the way to attend the hearing, called a fifteen (15) minutes recess to afford both parties the benefit of being represented by a lawyer. eAicad

When the second call was made, there was still no appearance of the counsel for the petitioner. The petitioner was directed to present her evidence on the injunction incident but for lack of technical know-how in legal procedure she failed to present any evidence on the incident.

IN VIEW OF THE FOREGOING, the Commission is constrained to consider the incident of preliminary injunction in the above-entitled case submitted for resolution on the basis of the pleadings filed.

SO ORDERED.
