For resolution is the Motion To Dismiss and/or Suspend the Proceeding filed by respondents dated September 2, 1987 on the ground that there is another case pending before SEC Extension Office in Cebu City involving the same parties and the same subject matter. ScaATD
After consideration of the arguments contained in the motion and the opposition thereto filed by the petitioner, the Commission finds said motion to be without merit.
WHEREFORE, the respondents' motion to dismiss/suspend the proceeding is hereby DENIED for lack of merit. IHaSED
Accordingly, let the continuation of hearing of the injunction incident be, as it is hereby set on January 13, 1988 at 2:00 o'clock in the afternoon.
