Authorizing the Sheriff to Issue a Notice to Lift Garnishment Once an Over Garnishment is Determined

September 16, 2015NLRC EN BANC RESOLUTION NO. 009-15WHEREAS, enforcement of Decisions of the Commission is effected by the Sheriffs through simultaneous service of Notice of Garnishment addressed to banks holding any deposit belonging to the respondent/s;WHEREAS, as a result thereof, there have been reports of over garnishment which unduly prejudiced the daily business operations of respondent/s;WHEREAS, there is a need to immediately lift the garnishment over the accounts in excess of the judgment award;WHEREFORE, RESOLVED AS IT IS HEREBY RESOLVED, that the Sheriff is authorized to issue a Notice to Lift Garnishment 1 once an over garnishment is determined; Provided, that the accounts deposited with the banks with the least assets according to the list issued by the Bangko Sentral ng Pilipinas, 2 shall be lifted first. aDSIHcSigned this 16th day of September 2015, Quezon City, Philippines.(SGD.)
