October 16, 2017.](NCR-QC-IN-01-18-10-16)IN RE: PETITION FOR INTERPLEADERCOCA-COLA FEMSA PHILIPPINES, INC., (CCFPI), petitioner-appellee, vs. COCA-COLA BOTTLERS PHIL., INC., SALES FORCE UNION-PHILIPPINE TRANSPORT AND GENERAL WORKERS ORGANIZATION (CCBPISFU-PTGWO), respondent-appellant,COCA-COLA SALES FORCE UNION-MEYCAUAYAN (CCSUM), respondent-appellee.RESOLUTIONFor resolution is the Motion for Reconsideration filed by Coca-Cola Sales Force Union-Meycauayan (CCSUM), from the Resolution issued by this Office on 01 September 2017, the dispositive portion of which reads: WHEREFORE, premises considered, the Memorandum of Appeal filed by Coca-Cola Bottlers Phil., Inc.-PTGWO (CCBPI-PTGWO) is GRANTED. The Order dated 10 January 2017 of DOLE NCR Mediator-Arbiter Joel P. Petaca is hereby REVERSED and SET ASIDE.Accordingly, the rank-and-file sales force employees assigned at Roosevelt, Quezon City shall be represented by CCBPISFU-PTGWO.SO RESOLVED.In its Motion for Reconsideration, Coca-Cola Sales Force Union-Meycauayan (CCSUM) argued that this Office committed error in granting the appeal on the ground that it violates the principle of res judicata. It averred that the decisions of this office in the Petition for Deregistration of CBA and in the Petition to Nullify a Certain portion of a CBA, affecting the same parties...
