May 31, 1976POLICY INSTRUCTIONS NO. 17-76COLLECTIVE AGREEMENT CERTIFICATIONPursuant to the policy of the Department to promote and maintain industrial peace between labor and management, the following guidelines are hereby promulgated for the guidance and information of all concerned:CBA, Certification1) A collective agreement entered into before the effectivity of the Labor Code of the Philippines shall be certified if the requirements of Presidential Decree No. 21 on the grievance machinery, voluntary arbitration and ratification are fully complied with.2) A collective agreement entered into in accordance with a final award of a voluntary or compulsory arbitrator shall automatically be certified upon receipt of the copy thereof by the Bureau of Labor Relations.3) A collective agreement entered into after the effectivity of the Labor Code shall be certified only if the following mandatory requirements are complied with:a) It is submitted within 30 days from execution or ratification.b) It provides for a term of not more than three (3) years, except when special circumstances required otherwise.c) It provides for an adequate grievance and voluntary arbitration machinery.d) It provides for...
