DIAZ, complainants-appellees, vs. SAMAHAN NG MANGGAGAWA SA CPCP and ROGER CUYNO, Union President, respondents-appellants.RESOLUTIONThis resolves the Notice of Appeal with Memorandum of Appeal filed by Samahan ng Manggagawa sa CPCP from the Order dated 24 October 2016 issued by DOLE-NCR Mediator-Arbiter Cesar P. Petate, the dispositive portion of which reads:WHEREFORE, premises considered, the instant petition is PARTIALLY GRANTED. Accordingly, the expulsion of petitioners Jaime A. Corado, Romeo Ferreras and Bernabe S. Diaz from the Samahan ng Manggagawa sa CPCP-KAMPIL are declared INVALID for lack of due process. Thus, Jaime A. Corado, Romeo Ferreras and Bernabe S. Diaz are hereby REINSTATED as members of Samahan ng Manggagawa sa CPCP-KAMPIL.FURTHER, Jaime A. Corado, Romeo Ferreras and Bernabe S. Diaz may seek entitlement to the benefits provided under their CBA upon payment of their arrears in their union dues.
