July 16, 1976DEPARTMENT ORDER NO. 007-76To insure a rational and systematic approach in the hiring, placement and protection of migratory workers (sacadas) in the sugar industry, and in accordance with the pertinent provisions of the New Labor Code, the following guidelines are hereby issued for the information and guidance of all concerned:COVERAGE1. These guidelines shall apply to the hiring and employment of migratory workers for work in the plantations in the sugar industry.MAIN POLICY1. Only direct hiring of migratory workers is allowed in the recruitment for work. Labor-only-contracting is considered illegal. cdtaiRECRUITMENT/PLACEMENT PROCEDURES1. Only planters and/or their duly authorized representative(s) can engage in the hiring of migratory workers.2. The duly designated representative(s) of the planters/haciendas must have a duly notarized certificate of employment from the planter or hacienda stating, among others, the following:a. That he is a regular and direct employee of the planter;b. The position and compensation of the authorized representative(s); andc. That he is not participating either by commission or similar participation in the earnings of the hired migratory workers.3. A list of...
