March 3, 1981POLICY INSTRUCTIONS NO. 46-81TO:All Concerned SUBJECT:Disposition and Settlement of Strikes and Related Issues In order to protect the public interest as well as the rights of workers and employers, and in line with the objectives of the Labor Code of the Philippines to promote and maintain sound stable industrial peace, the following policy instructions are hereby promulgated:1) P.D. 823, as amended, by P.D. 849 which regulates the rights to strike and to lockout including its implementing rules and regulations, LOI 368 and the Memorandum of Agreement between the Ministry of National Defense and the Ministry of Labor and Employment dated April 5, 1976 remain valid as the basic law and policy thereon until amended, modified or repealed by the Batasang Pambansa or appropriate public authorities;2) Work stoppages under the provisions of P.D. 823, as amended, may be legally staged only by the incumbent recognized or certified collective bargaining agent of the workers.
