April 23, 1976POLICY INSTRUCTIONS NO. 04-76TO:All Concerned SUBJECT:Disposition of Termination Cases Pursuant to Articles 228 and 278 (b) of the Labor Code, as amended, in relation to Rule X, Book III and Rules XII and XIV, Book V of the Revised Rules and Regulations Implementing the Code, the following operational guidelines are issued for all concerned for the appropriate disposition of termination cases.Filing and Assignment of Cases1. For purposes of this issuance, "termination cases" means those commenced by complaints for unjust dismissal or applications for clearance to dismiss or to shut down an establishment, including issues on preventive suspension.2. Complaints for unjust dismissal or applications for clearance shall be filed with the Regional Office having jurisdiction over the place of employment. Where the place of employment is under the jurisdiction of two or more Regional Offices, the acquisition of jurisdiction by one shall preclude the others. cdt3.
