August 2, 2010DOLE DEPARTMENT CIRCULAR NO. 003-10Pursuant to Section 5 (a) of Republic Act No. 9994 or the "Expanded Senior Citizens Act of 2010", this Circular is being issued to provide the following guidelines: SECTION 1. Declaration of Policies. —Article XIII, Section 3 of the Philippine Constitution provides that the State shall afford full protection to labor, local and overseas, organized and unorganized, and promote full employment and equality of employment opportunities for all.Section 5 (a) of Republic Act No. 9994 provides that senior citizens who have the capacity and desire to work, or be re-employed, shall be provided information and matching services to enable them to be productive members of society. Terms of employment shall conform with the provisions of the Labor Code, as amended, and other laws, rules and regulations.SECTION 2. Private Sector Participation. —Pursuant to Rule V, Article 13 of the Implementing Rules and Regulations of Republic Act No. 9994 and to ensure the full participation and cooperation of the private sector, private establishments and employers are encouraged to hire senior citizens...
