October 7, 1978POLICY INSTRUCTIONS NO. 38-77TO:All Concerned SUBJECT:Execution of Decisions, Awards and Orders; Stay of Execution Pursuant to the provisions of P.D. 1391 and to insure uniformity in the execution of decisions, awards and order of Regional Directors and Labor Arbiters, the following guidelines are hereby established for the guidance and compliance of all concerned:1. Issuance of Writs of ExecutionThe Labor Arbiter who decided the case shall himself issue the writ of execution. A writ of execution shall be issued only after the parties-litigants have been furnished with copies of the decision and after the expiration of the period of appeal.2. Execution before Expiration of Appeal PeriodA Labor Arbiter may issue a writ of execution to implement a decision involving monetary awards before the expiration of the period for appealing from the same where it is shown by the records of the proceedings that the judgment cannot be secured unless this is done.
