March 8, 2001NLRC MEMORANDUM CIRCULAR NO. 3-01-01FOR:All Officials and Employees This Commission FROM:The Chairman SUBJECT:Fake Bonds Reports submitted by the Committee created by Administrative Order No. 8-07, series of 2000, reveal that despite measures implemented pursuant to Section 6, Rule VI of the New Rules of Procedure of the NLRC, a considerable number of appellants-employers still post fake surety bonds in support of their appeal filed with the Commission and that this has become possible through the participation of some of our personnel. TEIHDaTo put an end to this practice, all concerned are hereby directed to strictly comply with the following guidelines:1. The Receiving Sections of the RABs shall upon receipt of the appeal indicate in the checklist, a copy of which is attached, submission of the following documents: a. Original copy of the bond;b. Amount of the bond;c. Certified copy of Supreme Court Certification that the bonding company has no outstanding liability;d. Certified copy of certificate of authority issued to the bonding company by the Insurance Commission; aCIHADe. Joint declaration under oath of employer...
