November 16, 2012NLRC MEMORANDUMTO:All Presiding/Commissioners SUBJECT:Guidelines in the Raffling of Extraordinary Remedies (ER) Cases To ensure the orderly assignment and raffle of Extraordinary Remedies cases (ER hereinafter) to all Commissioners, the following guidelines shall be strictly observed: 1. If there is a pending appeal and a party to the case subsequently files an ER, it shall be assigned to the same Commissioner handling the appeal;2. In the event an appeal is subsequently received after the filing and raffling of the ER, the appeal shall be raffled off to all Commissioners;3. In case where a second ER is filed by any of the parties, it shall be assigned to the same Commissioner where the first ER is still pending;4. If an ER is filed while a Motion for Reconsideration of the Resolution of the previous ER/s is pending resolution by the Division, the ER shall be raffled off to all Commissioners.
