June 14, 2018.](RO4-BPO-CE-07-19-09-17)IN RE: PETITION FOR CERTIFICATION ELECTION AMONG THE RANK-AND-FILE EMPLOYEES OF FURUKAWA AUTOMOTIVE SYSTEMS LIMA PHILIPPINES, INC.PHILIPPINE METAL WORKERS ALLIANCE (PMA), petitioner,FURUKAWA AUTOMOTIVE SYSTEMS LIMA PHILIPPINES, INC., employer.RESOLUTIONThis resolves the Memorandum of Appeal from the Order dated 22 January 2018 of the DOLE Regional Office No. IVA Mediator-Arbiter Rosita C. Villaluz, the dispositive portion of which reads: WHEREFORE, premises considered, the election protest filed by Obrero Pilipino-Furukawa Chapter is hereby dismissed for lack of merit. And for having garnered a convincing majority votes, Furukawa Employees Welfare Union-Philippines Metal Workers Alliance (FEWU-PMA) is hereby certified as the sole and exclusive bargaining agent of the rank-and-file employees of Furukawa Automotive Systems Phils., Inc.SO RESOLVED.The facts are as follows:On 09 September 2017, Furukawa Employees Welfare Union-Philippines Metal Workers Alliance 1 (FEWU-PMA) filed a Petition for Certification Election 2 seeking to represent more or less 2,000 regular rank-and-file employees of Furukawa Automotive Systems Phils., Inc.
