Villaluz, the dispositive portion of which reads:Premises considered, petitioner failed to earn more than the majority votes and consequently, NAGKAKAISANG MANGGAGAWA NG KEYRIN ELECTRONICS-INDEPENDENT (NMKE-Independent) cannot be certified as the sole and exclusive bargaining agent of the rank-and-file employees of Keyrin Electronics Phils., Inc. SO RESOLVED.The facts are as follows:On 08 October 2013, Nagkakaisang Manggagawa Ng Keyrin Electronics-Independent (NMKE-Independent) filed a petition for certification election seeking to represent all the regular rank-and-file employees of Keyrin Electronics (Phil.), Inc. 1 It alleged that the petition is supported by one hundred two (102) of the two hundred seventy five (275) rank-and-file employees.
