November 29, 1994.][RO700-9110-AU-013]IN RE: PETITION FOR AUDIT EXAMINATION OF THE COAST OF MAGELLAN AND MARINE DEVELOPERS EMPLOYEES LABOR UNION (CMMDELU-SPFL-KMU),ELIEZER ANTIPOLO, et al., petitioners.D E C I S I O NFor resolution is the motion for reconsideration, now treated as an appeal, filed by respondents-appellants Eliezer Antipolo, et al., from the order of the Regional Director dated 30 September 1992, the pertinent portions of which read:"Being the officers of CMMDEU, Tito P. Avergonzado and his fellow officers are responsible for the moneys paid to the union. As of December, 1991, the total amount of P235,142.18 was paid by CMMO, Inc. to CMMDEU. Having failed to account for the entire amount they should answer for it to the union and its members, less whatever amount that went to the share of the federation SPFL and violated the aforesaid rights and conditions of membership, their expulsion from office is justified."WHEREFORE, this order hereby issued directing Tito P. Avergonzado and his fellow officers to restitute to the Coast of Magellan Marine Developers Employees Labor...
