Labor Organization (ISTILO) from the decision of Regional Director Carlos L. Boteros dated 08 December 1999 ordering the dismissal of the instant petition for certification election. The dismissal is premised on the cancellation of ISTILO's certificate of registration due to violation of Article 239(a) of the Labor Code. ISTILO, a legitimate labor organization filed the petition on 20 October 1997. The employer is a corporation engaged in trucking and hauling and at the time the petition was filed, employed more or less 39 rank-and-file employees which comprises the bargaining unit ISTILO sought to represent.
