March 30, 2017.](RO4A-LPO-CE-08-18-07-16)IN RE: PETITION FOR CERTIFICATION ELECTION AMONG THE REGULAR RANK-AND-FILE EMPLOYEES OF SAGARA METRO PLASTIC INDUSTRIAL CORPORATIONOBRERO PILIPINO-SAGARA METRO PLASTIC CHAPTER, petitioner,LAKAS NG NAGKAKAISANG MANGGAGAWA SA SAGARA-INDEPENDENT, forced-intervenor,SAMAHAN NG MANGGAGAWA SA SAGARA-NAMAWU LOCAL 180, forced-intervenor.RESOLUTIONThis resolves the Motion for Reconsideration of Obrero Pilipino-Sagara Metro Plastic Chapter from our Resolution dated 21 February 2017, the dispositive portion of which reads:WHEREFORE, premises considered, the Memorandum of Appeal of Obrero Pilipino-Sagara Metro Plastic Chapter is hereby DISMISSED. The Order dated November 28, 2016 by Mediator-Arbiter Atty. Maureen Zena Serazon-Tongson is hereby AFFIRMED as to results. SO RESOLVED.Movant Obrero Pilipino-Sagara Metro Plastic Chapter contends that the questionable Collective Bargaining Agreement should not be used to render meaningless the worker's constitutional right to collective bargaining and self-organization, most particularly their right to select a bargaining representative given the unique situation in their company. It maintains that Lakas ng Nagkakaisang Manggagawa sa Sagara and Samahan ng Manggagawa sa Sagara-NAMAWU Local 180 do not anymore command the majority of the employees in the bargaining unit.We deny the Motion.After assiduous...
