November 14, 2014NLRC EN BANC RESOLUTION NO. 007-14INTRODUCING AMENDMENTS TO THE 2011 NLRC RULES OF PROCEDURE, AS AMENDEDPursuant to Article 218 (a) of the Labor Code, as amended, the National Labor Relations Commission, sitting en banc, RESOLVED TO ADOPT AND PROMULGATE, as it hereby, adopts and promulgate amendments to the "2011 NLRC Rules of Procedure, as amended," as follows: RULE XIIExtraordinary Remedies1. Section 1, Rule XII is hereby amended to read as follows:SEC. 1. Verified Petition. — A party aggrieved by any order or resolution of the Labor Arbiter, including a writ of execution and others issued during execution proceedings, may file a verified petition to annul or modify the same. The petition may be accompanied by an application for the issuance of a temporary restraining order and/or writ of preliminary or permanent injunction to enjoin the Labor Arbiter, or any person acting under his/her authority, to desist from enforcing said resolution, order or writ.RULE XIIICommission Seal and Records, and Powers and Duties of Commission Officials2.
