June 4, 2020POEA ADVISORY NO. 75-20NEW SPECIALIST IMMIGRATION ACT IN GERMANYThe German government has introduced its new Specialist Immigration Act, the "Fachkräftezuwanderungsgesetz," which took effect on March 1, 2020. The law was enacted to attract highly qualified foreigners from outside the European Union into Germany. Through the Act, the migration of professionals and skilled workers to migrate to Germany for work is facilitated. Considered as specialists under the Act are third-country nationals who:1) possess a domestic qualified vocational training or a foreign professional qualification equivalent to a domestic qualified vocational training, or2) have a German, a recognized foreign university degree or a foreign university degree comparable to a German university degree.The Act clarifies that prior to entry, the foreigners' qualifications are checked for competency equivalence.A foreigner from a non-EU member state who wants to work in Germany is required to possess an appropriate visa to enter the country, which can be applied for at the German diplomatic mission (embassy, consulate general) in the home country.For the information and guidance of all concerned.(SGD.)
