September 16, 2015NLRC EN BANC RESOLUTION NO. 008-15WHEREAS, the Commission exercises jurisdiction over cases certified to it by the Secretary of Labor and Employment;WHEREAS, there is a ministerial duty on the part of the Commission to issue Writs of Execution over these cases and other cases which it has jurisdiction;WHEREAS, Rule XIII, Section 4 (k) of the 2011 NLRC Rules of Procedure, as amended, on the duties and functions of the Executive Clerk and Deputy Executive Clerks of the Commission states that — "Other Functions — He/she shall perform other functions as directed by the Chairman or the Commission En Banc";WHEREAS, prevailing circumstances justify the need to include, among the duties and functions of the Executive Clerk/Deputy Executive Clerks, the issuance of writ of execution by authority or order of the Commission, for certified cases and other cases where the Commission has original jurisdiction.WHEREFORE, RESOLVED AS IT HEREBY RESOLVED that the issuance of writ of execution by authority or order of the Commission be included among the functions of the Executive Clerk/Deputy Executive Clerks.Signed this...
