September 26, 2018NLRC EN BANC RESOLUTION NO. 008-18WHEREAS, En Banc Resolution No. 14-13 (Series of 2013) provides that: Unless otherwise provided by law, rules or regulation, litigants (a) whose gross income and that of the members of their family do not exceed an amount double the monthly minimum wage for an employee; and (b) who do not own real property with a fair market value as stated in the current tax declaration of more than Three Hundred Thousand (Php300,000.00) pesos, shall be considered indigent litigants and shall be exempted from immediate payment of fees/charges, upon execution of an affidavit to that effect.WHEREAS, on 11 March 2014, En Banc Resolution No. 04-14, Series of 2014 was passed stating that complainants who execute a sworn Certification before the Labor Arbiter that s/he cannot afford payment shall be exempted from the following filing fees: a) Motion to Recompute Award; b) Motion for Postponement; and c) Petition for Extra-Ordinary Remedies;WHEREAS, to simplify the requirements in the availment of exemption from the payment of legal fees, the Commission en banc...
