September 22, 2017NLRC EN BANC RESOLUTION NO. 022-17WHEREAS, Section 2, Rule I of the 2011 NLRC Rules of Procedure, as amended, states that the Rules shall be liberally construed to carry out the objectives of the Constitution, the Labor Code and other relevant legislations, and to assist the parties in obtaining, just, expeditious and inexpensive resolution and settlement of labor disputes; WHEREAS, the 2011 NLRC Rules of Procedure, as amended, provides for mechanisms by which parties may settle their differences amicably with the approval of the Labor Arbiter or the Commission;WHEREAS, certain Labor Arbiters refuse to attest to settlement between the parties if either of their respective counsels are absent or the settlement is being opposed by the counsel for complainant;WHEREAS, jurisprudence avows that a client has an undoubted right to settle his/her litigation without the intervention of the attorney, for the former is generally conceded to have exclusive control over the subject matter of the litigation and may at anytime, if acting in good faith, settle and adjust the cause of action out of...
