2004DOLE ADVISORY NO. 001-04ON THE ADOPTION OF A STANDARDIZED METHODOLOGY FOR DETERMINING ARBITRAL AWARDSIn the interest of the service, these guidelines are hereby adopted as reference of the Office of the Secretary in resolving bargaining deadlocks pursuant to Article 263 of the Labor Code.While an arbitral award takes into account many diverse considerations and determinants, the standardized methodology herein adopted is intended to bring about predictability in the decision-making process and objective quality decisions and principled arbitration awards.I. Principled AwardsThe determination of a principled arbitration award rests upon two basic elements: 1. CORE VALUES. A principled award embodies the core values of fairness, reasonableness, early resolution, transparency, accountability, partnership, equity, continued business viability/competitiveness and a decent standard of living for workers.2. METHODOLOGY. So as to make functional/operational the above-cited embodiment of core values, a principled award shall, among others, take account of a standardized multi-criteria model with eighteen (18) measurable economic factors, to wit:A.
